Tłumaczę umowę o podwykonawstwo przetwarzania danych osobowych, opartą na tzw. modelowej umowie UE, zawartej w decyzji Komisji Europejskiej z 5 lutego 2010. W nagłówku dokumentu umowy jest nazwa: Subprocessing Agreement EU Model Contract based. Tłumaczona umowa została zawarta między dwoma podmiotami z dwóch różnych krajów, z tym rzecz jasna, jeden jest z Polski. Zaczyna się tak:

„Subprocessing Agreement Schedule for Client Programs

This Subprocessing Agreement Schedule (“Subprocessing Agreement) is entered into by and between XXX (Main Processor) and YYY in Poland (“Subprocessor”). (Each a “Party”, together the ‘Parties’). ‘’

Jak przetłumaczyć ,,schedule’’ w tym tytule? ,,Schedule’’ nie pojawia się więcej w treści umowy. Jedyne co mi przychodzi do głowy to to, że ta umowa jest dodatkiem/załącznikiem do ‘’client programs.’’ ,,Client programs” prawdopodobnie odnosi się do programów typu ,,privacy shield’’. Wyraz ,,program’’ występuje w umowie tylko raz, w tym kontekście: ,, Subprocessors which are self-certified under the EU-U.S. Privacy Shield or a similar program)’’.

Wiem, że trudno coś wymyślić nie mając przed sobą całej umowy, ale może coś komuś przyjdzie do głowy.
