Dutch term

doorgezette boetes

Dutch to English Law/Patents Law: Contract(s) technical due diligence report
"De vanuit de X *doorgezette* boetes naar Y en Z betreffen operationele risico’s welke naar onderaannemers worden doorgezet."

"Vanuit de risicoverdeling en de via Y/Z *doorgezette* toerekeningssystematiek is het niet mogelijk om een inschatting te maken van de maximaal in te schatten financiële gevolgen."

How am I to understand 'doorzetten' in the examples above? RSVP. TIA. Cheers, R.

Sounds to me like 'recharged' or 'passed on'.
Tina Vonhof (X) Jan 4, 2010:
Could it be that penalties were charged through to different companies or departments?
Robert Haslach Jan 4, 2010:
doorzetten The verb has the sense of "continuing" - and as there are both prime and sub contractors, this has the feeling of a "flow-down clause" - in which penalties continue and flow up and down the contracting chain - therefore the inability to estimate financial consequences since a penalty could impact the prime because of actions by the sub.
Happy New Year!

Sounds like it should be 'enforced'

apportioned damages; penalties passed on down the line

We need first to establish whether the target of the verb are contract penalties: prima facie unenforceable in Eng./Can.? law or liquidated damages for contract breach which are enforceable as a 'genuine pre-estimate of loss'.

On the hunch this is a straight (BE) apportionment/(AE) allocation scenario, I - as a non-Dutch/Belgian-Flemish/-Afrikaans interloper - have looked at the persuasive 4 discussion entries so far and wonder why no one else has plucked up the 'Dutch courage' to post an answer.
