mobilisations de créances

French to English Law/Patents Finance (general)
This is found in a reservation of title clause in standard terms of sale.

"L’acheteur s’interdit formellement de céder sous quelque forme que ce soit la créance sur le sous-acquéreur. Cette interdiction concerne les cessions ou mobilisations de créances sous toutes formes auprès des organisations bancaires"

My understanding of "cessions" is that it refers to the "assignment of receivables" but i'm not sure of the difference with "mobilisation".

thanks to everyone for your help - I think rkillings is the closest and that it is just a general way of covering the different ways of using receivables to generate cash flow

it's about turning receivables into cash The obvious way to do it is to sell them to a third party (bank, factor, etc.) at a discount. This is covered by 'cession', itself a form of mobilisation, so the repetition of that term is presumably meant to cover all other means of doing it (e.g., securitisation) without listing them individually.

I'm taking a stab at this, too, interpreting "créance" in this sense to refer more generally to "indebtedness" in a sales contract as opposed to a "receivable."
