Source text - English 1. Member States shall ensure that the information exchanged between the designated authority and the DGS is limited to the information that is strictly necessary for the exercise of the DGS’ tasks and responsibilities under this Directive and that such exchange of information respects the requirements laid down in Directive 96/9/EC of the European Parliament and of the Council.
2. Member States shall ensure that DGSs suspend the repayment referred to in Article 8(1) where a depositor or any person entitled to sums held in his or her account has been charged with an offence arising out of, or in relation to, money laundering or terrorist financing, pending the judgment of the court.
3. Member States shall ensure that DGSs are not held liable for any measures taken in accordance with the instructions of the Financial Intelligence Unit. DGSs shall use any information received from the Financial Intelligence Unit for the purposes of this Directive only.
4. Without prejudice to rights they may have under national law, DGSs that make payments under guarantee within a national framework shall have the right of subrogation to the rights of depositors in winding up or reorganisation proceedings for an amount equal to the DGSs payments made to depositors.
DGSs that make a contribution in the context of the resolution tools referred to in Article 37(3), point (a) or (b), of Directive 2014/59/EU, or in the context of measures taken in accordance with Article 11(5) of this Directive, shall have a claim against the residual credit institution for any loss incurred as a result of any contributions made to resolution pursuant to Article 109 of Directive 2014/59/EU or to the transfer made pursuant to Article 11(5) of this Directive in connection to losses which depositors otherwise would have borne.
That claim shall rank at the same level as deposits under national law governing normal insolvency proceedings.

Państwa członkowskie zapewniają, aby wymiana informacji między wyznaczonym organem a systemem gwarancji depozytów ograniczała się do informacji, które są niezbędne do wykonywania zadań i obowiązków systemu gwarancji depozytów na mocy niniejszej dyrektywy oraz aby taka wymiana informacji odbywała się z poszanowaniem wymogów określonych w dyrektywie 96/9/WE Parlamentu Europejskiego i Rady.
2. Państwa członkowskie zapewniają, że system gwarancji depozytów zawiesi wypłatę o której mowa w art. 8 ust. 1 do czasu wydania wyroku przez sąd, jeżeli deponentowi lub jakiejkolwiek innej osobie, która ma prawo do kwoty złożonej na rachunku, zostanie zarzucone przestępstwo, które ma związek z praniem pieniędzy lub finansowaniem terroryzmu.
3. Państwa członkowskie zapewniają, aby systemy gwarancji depozytów nie ponosiły odpowiedzialności za jakiekolwiek środki podjęte zgodnie z instrukcjami jednostki analityki finansowej. Systemy gwarancji depozytów wykorzystują wszelkie informacje otrzymane od jednostki analityki finansowej wyłącznie do celów niniejszej dyrektywy.
4. Bez uszczerbku dla praw, które mogą przysługiwać systemowi gwarancji depozytów na mocy prawa krajowego, systemy gwarancji depozytów dokonując płatności w ramach systemów krajowych, są upoważnione w ramach postępowania likwidacyjnego lub reorganizacyjnego do wstąpienia w prawa deponentów do wysokości dokonanych przez nich wpłat.
Systemy gwarancji depozytów, które wnoszą składkę w kontekście instrumentów restrukturyzacji i uporządkowanej likwidacji, o których mowa w art. 37 ust. 3 lit. a) lub b) dyrektywy 2014/59/UE, lub w kontekście środków podjętych zgodnie z art. 11 ust. 5 niniejszej dyrektywy, mają prawo roszczenia wobec pozostałej części instytucji kredytowej z tytułu wszelkich strat poniesionych w wyniku wniesienia składek na rzecz restrukturyzacji i uporządkowanej likwidacji zgodnie z art. 109 dyrektywy 2014/59/UE lub transferu dokonanego zgodnie z art. 11 ust. 5 niniejszej dyrektywy w związku ze stratami, które w przeciwnym razie ponieśliby deponenci.
Roszczenie to zaspokaja się w tej samej kolejności co depozyty na mocy przepisów krajowych regulujących zwykłe postępowanie w związku z niewypłacalnością.
