1. Climate Change Act 2008
1. 1 Background
In July 2005, Gordon Brown, then Chancellor of the Exchequer, commissioned Sir Nicholas Stern (now Lord Stern of Brentford) to provide an evidence based assessment of the economic impacts of climate change. This included the implications of moving to a low carbon global economy and the effects for the UK. In October 2006, The Economics of Climate Change: The Stern Review (‘The Stern Review’) was published, which concluded that “there is still time to avoid the worst impacts of climate change, if we take strong action now”. It stated that costs of stabilizing the climate were significant, but that they were manageable. It also argued that a delay “would be dangerous and much more costly” and that strong policy action was essential to cut emissions.
Following the publication of the Stern Review the then Government published a draft Climate Change Bill for public consultation and pre-legislative scrutiny in March 2007. The revised Bill was introduced in the House of Lords on 14 November 2007 and, following its passage through Parliament, received royal assent on 26 November 2008.
1.2 Key Provisions of the Act
The Climate Change act 2008 seeks to reduce greenhouse gas (GHG) emissions through a long-term targeted and “economically credible strategy”. It states that it is the duty of the Secretary of State to reduce the net UK carbon account for the year 2050 to at least 8-0 percent below the level of net UK emissions of targeted GHGs in 1990. Targeted GHGs are defined as:
• Carbon dioxide
• Methane
• Nitrous Oxide
• Hydrofluorocarbons
• Perfluorocarbons
• Sulphur Hexafluoride
The long-term target is translated into five-year carbon budgets. These are a series of recommendations which restrict the amount of GHGs the UK can legally emit, and are provided by the Government’s climate advisers, the Committee on Climate Change. The Committee is an independent statutory body established under the Climate Change Act 2008 to advise the UK and the devolved administrations on setting and meeting carbon budgets, and preparing for climate change. The Act requires the Secretary of State to set “carbon budgets”, report UK emissions to Parliament and report measures the Government will take to meet the. Carbon budgets currently run up until 2032, and are shown in table 1.

Το αναθεωρημένο νομοσχέδιο εισήχθη στη Βουλή των Λόρδων, στις 14 Νοεμβρίου 2007 και, μετά την έγκρισή του από το Κοινοβούλιο, έλαβε τη βασιλική έγκριση στις 26 Νοεμβρίου 2008 .
1.2 Βασικές Διατάξεις της Πράξης
Η Πράξη περί Κλιματικής Αλλαγής του 2008 επιδιώκει να μειώσει τις εκπομπές αερίων θερμοκηπίου (GHG) μέσω μίας μακροπρόθεσμα στοχευμένης και «οικονομικά αξιόπιστης στρατηγικής» . Δηλώνει ότι είναι καθήκον των υπουργών να μειωθεί η καθαρή καταγραφή διοξειδίου του άνθρακα του Ηνωμένου Βασιλείου για το έτος 2050 κατά τουλάχιστον 8-0 τοις εκατό χαμηλότερα από το επίπεδο των καθαρών εκπομπών στοχευμένων αερίων του θερμοκηπίου του Ηνωμένου Βασιλείου το 1990 . Τα στοχευμένα αέρια του θερμοκηπίου ορίζονται ως :
• Διοξείδιο του άνθρακα
• Μεθάνιο
• Υποξείδιο του αζώτου
• Υδροφθοράνθρακες
• Υπερφθοράνθρακες
• Εξαφθοριούχο θείο
Ο μακροπρόθεσμος στόχος μετατρέπεται σε πενταετείς προϋπολογισμούς διοξειδίου του άνθρακα. Πρόκειται για μία σειρά από προτάσεις που περιορίζουν την ποσότητα αεριών του θερμοκηπίου που μπορεί να εκπέμπει νόμιμα το Ηνωμένο Βασίλειο και παρέχονται από τους κλιματικούς συμβούλους της, την Επιτροπή για την Κλιματική Αλλαγή. Η Επιτροπή είναι ένα ανεξάρτητο θεσμικό όργανο που ιδρύθηκε βάσει της Πράξης περί Κλιματικής Αλλαγής του 2008, για να συμβουλεύσει το Ηνωμένο Βασίλειο και τις αποκεντρωμένες αρχές σχετικά με την εφαρμογή και την επίτευξη των προϋπολογισμών διοξειδίου του άνθρακα, αλλά και την προετοιμασία για την κλιματική αλλαγή . Η Πράξη απαιτεί οι υπουργοί να ορίσουν «προϋπολογισμούς διοξειδίου του άνθρακα», να αναφέρουν τις εκπομπές του Ηνωμένου Βασιλείου στο Κοινοβούλιο και να αναφέρουν επίσης τα μέτρα που θα λάβει η κυβέρνηση για να επιτευχθούν .
