Die dark figure zählt zu den klassischen Problemen statistischer Erhebungen. Der Handlungsimperativ unserer data-driven society, welche gezielt einen Unschärfebereich jenseits „realer Daten“ zu mobilisieren strebt, lässt nach den historischen Agenturen und Praktiken der Wissensproduktion im Schatten der Statistik fragen. Die teilweise international vernetzten und große Datenmengen verarbeitenden Programme are motivated by a desire to survey their population bis in ihr tiefstes Inneres, welches sie womöglich selbst noch gar nicht kennen. Die Schwierigkeit einer Erfassung der „Volksseele“, von Wilhelm Wundt zur nicht-substantiellen Entität erklärt und der wissenschaftlichen Erforschung zugänglich gemacht, lässt sich jedoch nicht auf Unvollständigkeit oder zu geringe Reichweite statistischer Erhebungen reduzieren. Vielmehr ist das Interesse an unknown crimes and cases als Sensibilisierung des „Gefahrensinns“ (Archiv für Mediengeschichte 2009) zu lesen. Jegliche dark figure, die Entkoppelung realer Vorkommnisse von ihrer faktischen Erfassbarkeit, und ihre Evokation partizipiert, so meine These, gleichermaßen an der Aussagekraft der Statistik als auch an der Wirkmächtigkeit eines Nicht-Wissens, vielfach medial angetrieben von unbestimmten Ängsten, Projektionen und Phantasmen.
Within the rich historiographical literature zur Statistik (Porter 1986, 1995; Desrosières 2005), Probabilistik (Hacking 1975, 1990, Krüger/Daston/Heidelberger 1987; Daston 1988; Gigerenzer et al. 1989), zu den Kriminalwissenschaften (z.B. Wetzel 2000) und der Gesundheitspolitik wurde die dark figure und ihre epistemologischen Implikationen kaum beachtet. Seitens der Soziologie wurde die Unkenntnis über das „wahre“ Ausmaß jeglicher Devianz in seiner bewahrenden Funktion vor einer vollständigen Verhaltenstransparenz als Stabilisierungsfaktor gesellschaftlicher Normen beschrieben (Popitz 1968). Den hier grundsätzlich angelegten Aspekt, dass es sich nicht einfach um ein unbeeinflussbares und unvermeidbares Nichtwissen (Twellmann 2014) handelt, greife ich auf und setze ihn in dessen Relation zu je spezifischen, sozial und politisch beeinflussten Technologien gouvernementaler Risikobewältigung.
Im Zentrum meines Vorhabens einer „Epistemologie der dark figure“ steht der scheinbare Gegensatz von Unkalkulierbarkeit und Erwartbarkeit. Um von ihr Kenntnis zu erlangen, bedarf es komplexer Agenturen und ausgefeilter Praktiken. Operationalisiert wurde dies neben dem Ausbau der Fahndung über zwei Strategien: dem Aufbau von Betreuungsangeboten und eines sich daran anschließenden Informationsnetzes.
- Im späten 19. Jahrhundert gerät mit der Moralstatistik, dem Versuch der statistischen Erfassung nichtinternierter psychisch Kranker (Engstrom 2003, Ledebur 2015), der mit großen Datenmengen ringenden Erhebung der „Rückfallstäter“ (Fleiter 2007), wie allgemein der Verselbständigung des Risikobegriffs (Castel 1983) ein „Anderes“ in den Bereich gouvernementalen Interessen. Mit ihm emergiert an der Schnittstelle der von der Degenerationstheorie geprägten forensischen Psychiatrie und der Strafrechtsreformbewegung nicht nur die Sorge vor einer als steigend angesehenen Zahl „psychopathischer Minderwertiger“ und „gemeingefährlicher Verbrecher“ (Foucault 2003) sondern auch der Begriff der „dark number“ (Oba 1906). Was der Kriminalpolizei, ihren Verbrecheralben, Kartothek und Zeitungsausschnittarchiv, aber auch dem Archiv der Psychiatrie entging, war alternativ einzufangen. Um 1900 wurde ein Netz leicht zugänglicher Institutionen wie Polikliniken, Antiselbstmordbüros und Fürsorgeinstitutionen eingerichtet, über die das Meldesystem verdichtet werden sollte.
- Mit Ende der 1920er Jahre lässt sich ein Aufschwung der an Kriminalbiologie und „Erbgesundheitspolitik“ ausgerichteten Dunkelzifferforschung beobachten. Kern ihrer Bestrebung war die Erhöhung der Anzeigebereitschaft der Bevölkerung. Die in Registrierungsmaschinerien wie dem kriminalbiologischen Zählblatt festgehaltenen Informationen zogen disziplinierend-repressive Maßnahmen nach sich.
- Seit den späten 1960er Jahren setzt die „kritische Kriminologie“ auf Opfer-, Täter- und Informantenbefragungen. Analog dazu offeriert die Gesundheitspolitik eine Vielzahl alternativer Betreuungsangebote, über die bislang unzugängliches Wissen generiert werden kann. Zudem wird der quantitative Angaben suggerierende Begriff der dark number zum weniger angreifbaren Forschungsfeld der dark figure transferiert.
Ähnlich einem „governing by risks“ lässt sich der strategische Einsatz eines – auf seine historischen Kontingenzen zu prüfendes und zu spezifizierendes – unsicheren Wissen beobachten. Die Unbestimmtheit der dark figure, welche deren Wahrheitsfähigkeit mit umschließt und nicht zuletzt statistische Aussagen auf scheinbar paradoxe Weise zu stabilisieren vermag, figuriert ihr epistemologisches Potential. Mit meiner Fallstudie zur Produktion approximativer Daten zeige ich deren konstitutives Moment in ihrer Wechselwirkung mit den daran geknüpften Maßnahmen auf und beleuchte damit den gegenwärtigen Einsatz dieses im Schatten der Statistik operierenden Nicht/Wissens.
Übersetzung - Englisch In Germany, studies on ‘the dark figure’ – an estimation of the number of unreported or undiscovered crimes – became recently part of large-scale research programs, such as the First and Second Periodical Report on Crime and Crime Control (2001-2006), the Victimization of Survey Module (2008-2010), and the Barometer of Security in Germany (2010-2013). These data, generated within the bounds of policy and science, were to grant efforts toward prevention and early intervention a new foundation. A similar interest is found in medicine: new services, such as those for dissociative personality disorders, addicts, or pedophiliac tendencies, are introduced with reference to an unknown dark figure.
The dark figure is party to the classic problems of statistical data collection. My intended project, concerning the historical epistemology of the dark figure, will investigate the ensemble of agencies, techniques, and practices – its various institutional and administrative mechanisms, acting within a field of foreboding and nescience. In order to acquire knowledge, not readily accessible to the state or medical institutions, and to enhance their possibility to survey and protect the social body, complex and highly fragile networks had to be established – networks, which require detailed study.
Within the historiographical literature on statistics (Porter 1986, 1995; Desrosières 2005), probability (Hacking 1975, 1990, Krüger/Daston/Heidelberger 1987; Daston 1988; Gigerenzer et al. 1989), criminology (e.g. Wetzel 2000), and healthcare policy, the dark figure and its social, cultural, and epistemological implications have received little attention. The lack of knowledge about the “true” measure of deviancy has been described as acting to stabilizer societal norms (Popitz 1968). The sociologists recognition that the dark figure points not only to an unswayable or inevitable knowledge (Twellmann 2014) forms the basis of that, which I intend to investigate, particularly in its relation to specific social and political technologies. Difficulties in gathering and recording the “Volksseele” cannot be wholly attributed to incomplete or small-sampled data collections. Rather, these interests in unknown crimes and unsolved cases are to be understood in the sense of raising the awareness of danger (Archiv für Mediengeschichte 2009). I conjecture that any such dark figure – the untangling of actual incidents from the ability to factually ascertain such incidents – and its evocation participate equally in the validity of statistics and the potency of the unknown, as propagated through fear, projection, and apparition by the media.
In the late 19th century, the homo criminalis became an imaginary “Other” sparking governmental interests. This is demonstrated with the graduation of the term “risk” to autonomous usage (Castel 1983). With “risk”, not only the fear of a perceptively growing number of the “psychopathically debased” and those “dangerous to public safety” (Foucault 2003) emerged at the interface of forensic psychiatry and the movement for reform of the criminal justice system; here, the term “dark number” (Oba 1906) appeared for the first time. Whatever and whichever had escaped the police, their record-keeping system, and their archive of newspaper clippings – though also the psychiatric archive – was to be recovered in other ways. A network of easy to access facilities, such as health clinics, suicide prevention offices and welfare institutions, was established around 1900, through which this system for detection and reporting was to be intensified.
An increase in the popularity of ‘dark figure’ research can be witnessed at the end of the 1920s in criminal biology and eugenics. At the center of these research efforts was an intended intensification in the willingness of the general population to report any deviance. The information codified within cogs of the registration apparatus, such as the criminal biology count sheet, was succeeded by more repressive disciplinary measures.
Since the late 1960s, surveys conducted with victims, perpetrators, and informants came up within ‘critical criminology’. Relatedly, public healthcare policy has yielded a multitude of alternative services, which have so far worked to generate a largely inaccessible body of knowledge. In addition, the term ‘dark number’ has been transformed into ‘dark figure’.
Similar to “governing by risk”, a strategic employment of uncertain knowledge – to be tested and specified according to its historical contingencies – can be witnessed, here. The indeterminacy of the dark figure, whether in terms of its veracity or whether statistical claims might be paradoxically stabilized through its usage, confirms its epistemological potential. With my study on the production of approximate data, I will demonstrate the constitutive moments in the interplay between data and those measures so linked to their collection. In doing so, I will shed light on its contemporary utilization in the shadow of statistical knowledge.

Ausgangstext - Deutsch Das Militärstrafrecht des Lex Baiuvariorum

Abstract: Der Beitrag untersucht Einflüsse des spätrömischen Militärrechts in der Lex Baiuvariorum, mit der die merowingischen Könige das östliche Grenzgebiet des Frankenreiches als Dukat („Herzogtum“) organisierten. Nach einigen Überlegungen zum historischen Hintergrund der Einrichtung des bairischen Dukates werden die Bestimmungen zum Schutz des bairischen dux untersucht, vor allem zum Verrat und zur militärischen Disziplin. Durch den Vergleich mit Quellen zum römischen crimen laesae maiestatis und Rechtstexten bei den römischen Militärschriftstellern wird zunächst gezeigt, dass die Bestimmungen der bairischen Lex sehr deutlich vom römischen Militärrecht beeinflusst sind, wobei insbesondere die arbiträren Strafen, die der dux bei schweren disziplinarischen und anderen Vergehen verhängen durfte, weniger auf einen „staats-“ als „militärrechtlichen“ Rezeptions- und Aneignungszusammenhang schließen lassen. In der Klärung dieser Einflüsse geht die Studie aus von der Auffassung Heinrich Brunners, dass sich im Dukatstitel der bairischen lex Regelungen eines allgemeinen, im früheren 7. Jahrhundert wohl von den merowingischen Königen Chlothar II. oder Dagobert I. verfügten Erlasses niedergeschlagen haben, der ursprünglich nicht allein auf Baiern bezogen war, sondern für die fränkischen Dukate überhaupt einen rechtlichen Rahmen abgeben sollte. Die militärrechtlichen Elemente in der Lex Baiuvariorum sind daher, so wird abschließend vermutet, nicht direkt aus römischen Rechtsquellen rezipiert worden, sondern mittelbar oder unmittelbar aus älteren römischrechtlich beeinflussten Rechtstexten, die im nachrömischen Gallien entstanden sind und alsbald bezogen auf die Verhältnisse der fränkischen Dukate zu einem Rahmentext zusammengestellt wurden.
Die Beschäftigung mit den Leges barbarorum, wie man die frühmittelalterlichen „Volks-“ oder auch „Stammesrechte“ seit einiger Zeit zu bezeichnen pflegt, kann bereits auf eine lange Forschungsgeschichte zurückblicken, die nicht selten im Dienst nationalgeschichtlicher Meistererzählungen stand. Seit dem zweiten Weltkrieg hat die Erfoschung dieser Texte viele neue Wege eingeschlagen. Grob lassen sich dabei vier bis in die Gegenwart geführte Diskussionen benennen, welche die Substanz des Gattungsbegriffes Leges barbarorum berühren: Zunächst trug (1) die Entdeckung des spätrömischen Vulgarrechts und seiner Rezeption in den frühmittelalterlichen Rechtsaufzeichnungen dazu bei, die einstmalige scharfe Dichothomie einer Gegenüberstellung von „römischem“ und „germanischem“ Recht zu überwinden. Seitdem werden fließendere Übergänge vom antiken zum frühmittelalterlichen Recht angenommen. Mittlerweile sind zwar das Ausmaß der „Vulgarisierung“ des spätrömischen Rechts und auch die Bezeichnung „Vulgarisierung“ oder „Vulgarismus“ strittig geworden, doch dürfte eine wichtige bleibende Erkenntnis darin liegen, dass für die Betrachtung möglicher Kontinuitäten und Adapationen römischer Rechtspraxis der jeweilige provinzialrömische Kontext entscheidend aufgewertet worden ist. Sodann hat (2) die seit den 1970er Jahren geführte Debatte über die Rolle von Schriftlichkeit im frühmittelalterlichen Rechtsleben mit Blick auf die Leges barbarorum die Frage nach der Funktionalität und praktischen Verwendbarkeit dieser Texte und nach deren Verhältnis zur mündlichen Rechtspraxis bzw. zum Gewohnheitsrecht aufgeworfen. Das Regelungsinteresse einzelner Leges wird seither auf verschiedenen Ebenen gesehen, weshalb jenseits der Frage ihrer Anwendung oder Nicht-Anwendung vor Gericht die symbolische Bedeutung der Leges stark betont worden ist und zuletzt auch wieder vermehrt die Techniken der Komposition der Leges und der Verwendung schriftlicher Vorlagen behandelt worden sind. Als Folge dieser Erkenntnisse, aber auch infolge der Erforschung des mittelalterlichen Rechtsbegriffes ist dann (3) grundsätzlich die Annahme in Frage gestellt worden, man könne in diesen Rechtsaufzeichnungen „das germanische Recht“ (wenn es denn dieses je gab) wesensmäßig erfassen. Stattdessen sucht man die Leges zunehmend unter Berücksichtigung der anderen zeitgleich entstandenen bzw. verfügbaren Rechtstexte zu kontextualisieren. Und schließlich hat (4) der vergleichende Blick auf verschiedene Texte deutlich gemacht, dass der Sammelbegriff Leges barbarorum nur mehr als begrenzt erkenntnisfördernd einzustufen ist, da die darunter subsumierten Texte inhaltlich zu verschieden sind und ihre Aufzeichnung bzw. Redaktion offenkundig von sehr unterschiedlichen Regelungsanliegen bestimmt war. Die Zusammenstellung mehrerer Leges in Sammelhandschriften, wie sie aus karolingischer Zeit in z. T. sehr verschiedenen Kombinationen erhalten sind, müssen daher als der Versuch verstanden werden, die ihrer Genese und ursprünglichen Zielsetzung nach durchaus verschiedenen Texte einem neuen, gemeinsamen administrativen und „ideologischen“ Zweck zuzuführen. Auch die unter Karl dem Grossen und Ludwig dem Frommen inaugurierten „Leges-Aufzeichnungen“ und „Leges-Revisionen“ müssen vor allem aus den rechtspolitischen Zielsetzungen dieser Zeit heraus verstanden werden.
Aus diesen Gründen verspricht der Terminus Leges barbarorum für die vorkarolingische Epoche heute keinen allzu großen Erkenntnisgewinn mehr, wenn man ihn als Gattungsbegriff verwendet. Dies ist umso nachdrücklicher zu betonen, insofern bei den in diesen Texten behandelten Leitthemen und Gegenständen wichtige Fortschritte erzielt worden sind, etwa zum Familien- und Erbrecht, zum Handelsrecht und zu religiösen Vergehen, aber auch zum Verfahrens- und Strafrecht sowie zum Bußen- und Wergeldsystem, um nur einige der wichtigsten Bereiche zu nennen. Rechts- und legesvergleichende Studien behalten insofern selbstverständlich ihre Relevanz, doch sollte man in der Befreiung vom Konzept des „germanischen Rechts“ und dem Verzicht auf eine inhaltlich begründete angenommene Gattungskohärenz der Leges barbarorum vor allem die Chance sehen, die einzelnen Texte auf komplexere und neuartige Weise historisch wie rechtshistorisch zu kontextualisieren.
Seit einiger Zeit nun wird zunehmend ein neues Feld erschlossen, auf dem sich die Übergänge zwischen antikem und mittelalterlichen Recht als fließend erweisen und das offenkundig einigen Erkenntnisgewinn für viele der unter dem Kunstbegriff Leges barbarorum subsumierten Texte verspricht, nämlich der Einfluss des spätrömischen Militärrechts auf Recht und politische Organisation der nachrömischen Reiche. Da alle gentes, denen seit dem 5. Jahrhundert im spätrömischen Westen eine Reichsbildung gelang, in der Spätantike als römische Foederaten gedient hatten und als solche sowohl auf den römischen Kaiser vereidigt als auch der Befehlsgewalt römischer Offiziere unterstellt gewesen waren, hat die Annahme einer tiefgehenden Beeinflussung durch römisches Militärrecht von vornherein viel für sich. Einige Eigenheiten frühmittelalterlichen Rechts sind bereits auf Prägungen durch das römische Militärrecht untersucht worden, etwa die Bedeutung des vom römischen Fahneneides beeinflussten Treueides und der damit in Verbindung stehenden Rechtsinstitute und -konzepte (Fidelität, Huld, Bann), sodann bestimmte Bestrafungsformen, die Verbindung von Militär- und Zivilgewalt in den Händen der comites, das in verschiedenen Leges angesprochene Problem der Militärdienstpflicht, der Besitz und die Vererbung militärischer Güter, u. a. m.
Die meisten dieser Befunde sind notgedrungen punktueller Natur, ist doch bereits die Rekonstruktion des römischen Militärrechts selbst ein mühsames Unterfangen. Denn neben entsprechenden juristischen Kommentierungen De re militari aus der früheren Kaiserzeit (Tarruntenus Paternus, Arrius Menander), etwa zu Dienstvergehen, zum Eherecht und zum soldatischen Vermögen, die verstreut in den Digesten zitiert werden, hat es offenkundig erst in spätrömischer Zeit Versuche gegeben, dieses Recht in Textsammlungen systematisch zusammenzustellen. Die im Buch VII De re militari des Codex Theodosianus versammelten Kaisergesetze behandeln wichtige Fragen vor allem der Militärorganisation und Verwaltung, äußern sich jedoch wenig zum soldatischen Verhaltenscodex. Hierfür wiederum sind verschiedene, z. T. der Praxis entstammende Texte aussagekräftig, die eigene Militärrechtsbestimmungen einschließen, deren zeitliche Einordnung und Autorschaft allerdings z. T. strittig ist. Am wichtigsten darunter ist das dem römischen Kaiser Maurikios (582–602) zugeschriebene griechischsprachige Strategikon, dessen das Militärrecht betreffende Regelungen offenkundig auf ältere, in lateinischer Sprache verfasste Bestimmungen zurückgehen. Eine präzise Nachzeichnung militärrechtlicher Einflüsse wird weiterhin dadurch erschwert, dass vieles davon eingespieltes, nicht schriftlich fixiertes Gewohnheitsrecht war und gerade das militärische Strafrecht eine häufig flexible Handhabung kennzeichnete, die sich per definitionem nicht bis ins letzte Detail festschreiben ließ.
Mit Blick auf die frühmittelalterlichen Rechtsaufzeichnungen und ihre Prägung durch römisches Militärrecht wird man in Rechnung stellen müssen, dass die Art der Beeinflussung einzelner Leges nach Entstehungsumständen, Funktionskontexten und Zwecksetzungen der Texte sehr stark variieren konnte. So ist jüngst mit bedenkenswerten Gründen in Zweifel gezogen worden, ob man beispielsweise das Gros der in der Lex Salica enthaltenen Bestimmungen überhaupt – wie teilweise geschehen – sinnvollerweise als „Militärrecht“ ansprechen sollte. Dem ist hinzuzufügen, dass militärrechtliche Bezüge in Texten wie der für die im Rheinland lebende Bevölkerung im 7. Jahrhundert aufgezeichneten Lex Ribuaria viel konkreter zu greifen sind als in der Lex Salica, die ja in vielen anderen Hinsichten gerade den Grundstock der Lex Ribuaria gebildet hatte.
Neben solchen Differenzierungen verlangt offenkundig auch der Begriff „Militärrecht“ selbst, hinter dem sich höchst unterschiedliche Dinge verbergen können, nach einer Klärung seines Bedeutungsspektrums und der Konsistenz der unterm diesem Begriff eingeordneten Regelungen. Meint „Militärrecht“ vor allem das Recht des Kriegszustandes oder schließt der Terminus Kompetenzen militärischer Befehlshaber gegenüber der Zivilbevölkerung und in nicht primär „militärische“ Regelungsbereiche ein? Wie weit erfasst es das sonstige Leben des Soldaten? Bezieht es sich auf die geordnete Armee oder auf in Kolonien oder anderen Militärsiedlungen mit ihren Familien lebenden Bevölkerungsgruppen, die von ihrem Umland getrennt waren? Und schlugen sich, so wird man mit Blick auf die vom römischen „Militärrecht“ inkubierten Personengruppen wissen wollen, in diesem Unterschiede zwischen regulären Einheiten und Grenzverbänden bzw. Foederaten nieder? Gerade wenn man die weitere Entwicklung im Frühmittelalter und ihre Abkehr von der spätrömischen Praxis berücksichtigt, erscheinen Fragen wie die folgenden keineswegs als nebensächlich: Was bedeutet „Militärrecht“ vor dem Hintergrund, dass im Frühmittelalter die Trennung von Militär- und Zivilverwaltung aufgegeben wurde und militärischen Kommandeuren in größerem Umfang jurisdiktionelle Aufgaben zuwuchsen? Und welche Konsequenzen hatte es, wenn seit dem 6. Jahrhundert in mehreren poströmischen regna die freie männliche Bevölkerung als prinzipiell militärdienstpflichtig betrachtet wurde, die Gesellschaft sich also insgesamt militarisierte? Welche Bereiche des politischen und gesellschaftlichen Lebens wurden von „militärrechtlichen“ Normen stärker und welche nur wenig oder gar nicht erfasst? Wie änderte sich der Charakter des „Militärrechts“, wenn dieses von einem eher sektorial angewandten zunehmend zu einem „allgemeinen“ Recht wurde, welches Steuerungs-, Lenkungs- und Befriedungsfunktionen innerhalb einer sich etablierenden politischen Hierarchie erfüllte?
Vor dem Hintergrund der skizzierten doppelten Forschungsproblematik zu den Leges barbarorum wie zur Aneignung des römischen Militärrechts verfolgt der folgende Beitrag ein eher begrenztes Ziel. Fokussiert auf eine einzelne Rechtsaufzeichnung, die Lex Baiuvariorum, soll deren – noch nicht eingehender untersuchte – Beeinflussung durch das römische Militärrecht analysiert werden, ohne dabei vom Sammelbegriff der Leges barbarorum auszugehen. Stattdessen sollen zunächst (1) mit dem fränkischen Dukat Baiern der historische Entstehungskontext und das intendierte Anwendungsgebiet der Lex Baiuvariorum (2) näher umrissen werden, bevor (3) an einigen Beispielen im Text selbst nachweisbare militärrechtliche Einflüsse herauszuarbeiten sind, die in vielen Hinsichten eine römische Prägung verraten. Die Frage nach möglichen militärrechtlichen Quellen und nach deren frühmittelalterlicher Vermittlung soll abschließend (4) behandelt werden.
1. Der merowingische Dukat Baiern
Baiuvaria ist keine antike, sondern eine frühmittelalterliche geographische Bezeichnung. Auch die Baiuvaren sind in unseren Quellen nicht vor der Mitte des 6. Jahrhunderts bezeugt. Da es sich offenkundig bei ihnen nicht um einen alten germanischen Stamm handelt, erscheint es sinnvoll, bei einer Behandlung des bairischen Dukates die vieldiskutierte Frage nach der ethnischen Identität der Baiern und ihrer Ursprünge hintanzustellen und stattdessen von jenem Gebiet auszugehen, das seit dem Frühmittelalter als Baiuvaria bezeichnet und von den Franken als Dukat organisiert wurde. Sie erfolgte in den späteren 530er Jahren, wahrscheinlich, wie einige Historiker angenommen haben, um das Jahr 537/538. Die Errichtung des Dukates Baiern ist daher in den größeren Zusammenhang der um 535 einsetzenden oströmischen Reorganisation militärischer und provinzieller Strukturen auf dem Balkan zu stellen, die Teil von Justinians Plänen war, die Ostgoten aus Italien zu vertreiben. Unter Druck geraten, hat der Ostgotenkönig Witgis die unter ostgotischer Herrschaft stehenden Gebiete „Oberitaliens“, die zur italischen Präfektur gehörten, an die Franken abgetreten, die damit auch zu den neuen Herren des Alpengebietes wurden. Wie sich Justinian dazu verhielt, ist nicht explizit belegt, doch liegt es nahe, in Analogie mit seiner sicher bezeugten Zustimmung zur ostgotischen Abtretung der Provence an die Franken im Jahr 536 den Schluss zu ziehen, dass es hier um einen auch seitens Ostroms legitimierten umfassenden Machtwechsel ging. Ian Wood hat sogar angenommen, dass die oströmische Zustimmung zur Vergrößerung des fränkischen Territoriums das Gebiet des Burgunderreiches eingeschlossen haben könnte, welches sich die Franken unmittelbar zuvor, im Jahr 534, einverleibt hatten. Dazu möchte man noch hinzufügen, dass die Franken unmittelbar zuvor das Thüringerreich vernichtet hatten, was mittelfristig auch die Errichtung eines thüringischen Dukates nach zog, und dass bereits 537 die fränkisch-langobardische Eheallianz zwischen Theudebert I. und Wisgarde die neue Konstellation absichern half. Dies gehörte ebenso zu den Voraussetzungen der Errichtung des bairischen Dukates wie die im selben Zusammenhang erfolgte Begründung des angrenzenden Dukates Alamannien. Die Jahre zwischen 533 und 538 erscheinen aus diesem Grund als eine Phase folgenreicher Veränderungen nördlich und südlich der Alpen. Was während dieser Zeit in Baiern geschah, war daher aller Wahrscheinlichkeit alles andere als eine rein lokale Angelegenheit, sondern Teil eines weitaus größeren fränkischen Versuches, in Abstimmung mit Ostrom eine grundlegende politische Neuordnung der östlichen Gebietes des Frankenreiches zu veranlassen, die in einem 534 oder kurze Zeit später verfassten Brief Theudeberts I. an Justinian sowie einem von Prokop überlieferten Brief Justinians an die fränkischen Könige einen beredten Ausdruck gefunden hat. Die schon 539 einsetzende Invasion Oberitaliens durch den ostfränkischen König Theudebert I. scheint eine solche Neuregelung jedenfalls bereits vorauszusetzen.
Außer als Basis für expansive Pläne diente Baiern in seiner Eigenschaft als merowingischer Dukat vor allem der Verteidigung und Grenzsicherung der östlichen und südöstlichen Grenze des Frankenreiches. Das Gebiet des Dukates setzte sich im Wesentlichen aus dem Territorium zweier einstiger römischer Provinzen zusammen, der Raetia Secunda sowie der Provinz Noricum ripense. Die Franken nahmen diese Gebiete in Besitz und richteten eine Militäradministration für das neue Grenzgebiet ein, die einem dux unterstellt wurde. Dies ist deswegen von Bedeutung, weil der Dukat Baiern allem Anschein nach nicht die direkte und bruchlose Fortsetzung eines antiken Dukates war. Es hatte zwar einen dux Raetiarum in der spätrömischen und ostgotischen Zeit gegeben. Aber seine Funktion war die Verteidigung der nördlichen Grenze des römischen Imperium und später des ostgotischen Italien gewesen, wohingegen in der merowingischen Zeit das zwei einstige Provinzen umfassende Gebiet des bairischen Dukates Teil der südlichen und südöstlichen Verteidigungslinie des Frankenreiches wurde. Zugespitzt könnte man also sagen, dass die Region, welche einst den Norden eines Reiches gebildet hatte, fortan den Süden eines anderen Reiches bildete. Aber welchen Unterschied würde dies ausmachen?
Ein wichtiges Thema der jüngsten Forschung ist die Frage, welcher Ort als der „Hauptsitz“ des frühmittelalterlichen Dukates Baiern anzusprechen ist, an welchem der dux residierte und von wo aus er die militärischen und administrativen Aufgaben des Dukates wahrnahm. Lange Zeit hat man angenommen, dass während der gesamten Dauer des bairischen Dukates Regensburg, das einstige römische castra Regina, dessen Hauptstadt gewesen sei. Während kein Zweifel daran bestehen kann, dass Regensburg im Laufe des 7. Jahrhunderts als Hauptsitz der agilolfingischen duces diente, hat kürzlich Arno Rettner die These aufgestellt, dass wenigstens im sechsten und früheren siebten Jahrhundert Augsburg (Augusta Vindelicorum) der Hauptsitz des bairischen dux gewesen sein dürfte. Trifft Rettners Vermutung zu – was mir sehr plausibel erscheint – so lässt sie den gesamten Prozess der Entstehung des bairischen Dukates in einem anderen Licht erscheinen. Augsburg war die Hauptstadt der spätrömischen Provinz Raetia secunda gewesen, so dass die Merowinger offenkundig bei der Einrichtung des Dukates Baiern vorgefundene Strukturen integriert haben, indem sie sie aus der zerfallenen ostgotischen Administration des nördlichen Alpenraumes herauslösten und mit dem Gebiet der einstigen römischen Provinz Ufernorikum verbanden. Noricum ripense scheint allerdings nicht mehr unter direkter Kontrolle der Ostgoten gestanden zu haben, oder stand zumindest einer oströmischen Einflussnahme von der Zeit Justinians an offener gegenüber. Zugleich muss jedoch dann von Augsburg aus das Gebiet der einstigen Provinzen funktional neu ausgerichtet worden sein.
Entscheidende war in diesem Zusammenhang, wie sich die noch vorhandenen Strukturen in den neu geschaffenen bairischen Dukat einbauen ließen. Deren Bedeutung ist allenfalls ansatzweise der Notitia dignitatum zu entnehmen, die nur die wichtigsten Straßen und Befestigungen erkennen lässt, während sich ein weitaus umfassenderes Bild ergibt, sobald das Hinterland der Grenze mit Hilfe der Tabula Peutingeriana und unter Hinzuziehung archäologischer Zeugnisse rekonstruiert wird. Neben Dutzenden Kastellen (castella) und kleineren Festungen (burgi) ist hier vor allem an unterschiedliche weitere militärisch bedeutsame Strukturen wie Straßen (viae), an diesen gelegene Stationen (mansiones), Getreidespeicher (horrea), Fiskalgüter und sogar pagi zu denken. Viele dieser Ressourcen und Infrastrukturen verschwanden nicht, als das weströmische Reich unterging, bestanden vielmehr auch unter ostgotischer Herrschaft fort und sollten diese überdauern. Für jede politische Macht, die über diese Gebiete in den folgenden Jahrhunderten ihre Herrschaft zu etablieren suchte, war es von fundamentaler Bedeutung, vorhandene römischen Strukturen, soweit es möglich und sinnvoll war, zu übernehmen, anzupassen, sie ggf. wiederzubeleben. Die spätrömische Verteidigungsstrategie war zudem keineswegs allein auf den Schutz der Donaulinie beschränkt gewesen, sondern implizierte die Strukturierung und Kontrolle von Kommunikation und Mobilität im gesamten Voralpengebiet und darüber hinaus, und auch die fränkischen Herrscher haben sich bemüht, Handel, Reisen und Austausch innerhalb und außerhalb der gesamten Region ihrer Kontrolle zu unterwerfen – nicht zuletzt mit Blick auf die Alpen. Überdies finden wir, obwohl die Vita des Severin von Noricum den Schluss nahelegt, dass sich gegen Ende des 5. Jahrhunderts die römische Verwaltung aus dem Gebiet Noricums völlig zurückgezogen hätte, ungeachtet dessen in den folgenden Jahrhunderten immer wieder Bevölkerungsgruppen in den Quellen, die als Romani exercitales und tributarii bezeichnet werden. Dies gilt besonders für die Gegend um Salzburg, für die eine gute urkundliche Überlieferung vorliegt, aber es gibt auch weitere Informationssplitter, die Ähnliches auch für andere Gebiete begründet vermuten lassen. Offenbar handelte es ich bei ihnen um militärisches Personal mit besonderer Verpflichtung zum Militärdienst, für den sie als materiellen Anreiz bzw. als Besoldung Grundbesitz erhalten hatten, möglicherweise regelrechte Militärgüter. Bei der “Kontinuität” und dem “Fortleben” römischer Strukturen wird es sich demnach häufig um ein sehr lokales Phänomen gehandelt haben, während im Bereich der „Suprastrukturen“ mit vielfältigen Brüchen zu rechnen ist. Im Fall Baierns ist also zu überlegen, was bestimmte römische Elemente fortbestehen ließ, wie diese lokal an neue Bedingungen angepasst wurden und warum anderswo römische Traditionen offensichtlich mehr oder weniger vollständig verschwanden. Und Überlegungen dieser Art sind es, die auch den Hintergrund bilden müssen, wenn es darum geht, die Bestimmungen der Lex Baiuvariorum als sinnhaft zu verstehen – etwa wenn in der Lex an einer einzigen Stelle ohne jede weitere Information von viae publicae die Rede ist.
2. Die Lex Baiuvariorum: Entstehung, Komposition, Quellen
Der politische und administrative Kontext des bairischen Dukates stellt einen wichtigen Hintergrund dar, um die darauf bezüglichen Quellentexte zu verstehen und sie interpretieren zu können. Gleichwohl ist vorweg zu betonen, dass ein grundsätzlich andersartiges Terrain betreten wird, sobald von Texten die Rede ist. Es besitzt zwar eine gewisse Wahrscheinlichkeit, dass es bereits im Zuge der Einrichtung und ersten Ausgestaltung des Dukates Baiern im 6. Jahrhundert zur schriftlichen Niederlegung diesbezüglicher Normen kam, doch ist davon nichts unmittelbar erhalten. Die wichtigste Quelle zur administrativen Ausgestaltung des bairischen Dukates ist die offenkundig wesentlich später entstandene Lex Baiuvariorum, die einen eigenen Titel mit Bestimmungen zu den Funktionen des bairischen dux enthält. Bei der bairischen Lex handelt es sich um einen unter Historikern wie Rechtshistorikern gleichermaßen umstrittenen Text, dessen Entstehungszeit, Komposition, Quellen und Wirkungen präzise einzuschätzen erhebliche Schwierigkeiten bereitet. Was ihre Entstehungszeit anbetrifft, so stehen sich hier im wesentlichen zwei von Rechtshistorikern formulierte und zumeist auch von Historikern übernommene oder modifizierte Thesen gegenüber, die beide von der spät, nämlich in frühkarolingischer Zeit (spätes 8. Jahrhundert) einsetzenden handschriftlichen Überlieferung des Textes auszugehen haben. Die am ausführlichsten von Konrad Beyerle formulierte und jüngst von Peter Landau bekräftigte Theorie schließt aus der recht hohen Einheitlichkeit dieser Überlieferung und aus der politischen Entwicklung des bairischen Dukates in dieser Zeit, dass die Lex Baiuvariorum erst spät, nämlich – in unterschiedlicher Akzentuierung – zwischen den späten 720er und den 740er Jahren entstanden sein könne, und bringen dies mit Spannungen innerhalb der agilolfingischen Herzogsdynastie, die damals in Regensburg residierte, in Verbindung. Nur schwer vereinbar mit dieser Annahme einer einheitlichen Redaktion und Entstehung der gesamten Lex ist dagegen die von Heinrich Brunner entwickelte, später von Franz Beyerle verfeinerte und jüngst mit wichtigen Differenzierungen von Hermann Nehlsen und Harald Siems bekräftigte Hypothese, dass sich in dem heute erhaltenen Text der Rechtsaufzeichnung verschiedene ältere Textschichten niedergeschlagen haben; unter diesen sei von besonderer Bedeutung ein aufgrund seiner inhaltlichen und sprachlichen Eigenart erkennbarer merowingischer Herrschererlass, der in die legislativen Bemühungen der merowingischen Könige im früheren 7. Jahrhundert einzuordnen sei, dem auch Rechtsaufzeichnungen wie der Pactus bzw. die Lex Alemannorum sowie die Lex Ribuaria zu verdanken seien; dieser Befund wird dann nicht selten mit dem der Lex Baiuvariorum vorangestellten langen Prolog verbunden, demzufolge deren Redaktionsgeschichte im 6. Jahrhundert einsetzte und vor allem durch die fränkischen Könige Chlothar II. (584–629) und Dagobert I. (629–639) vorangetrieben worden sei. Entscheidend ist dabei Brunners Argument, dass der angenommene heute verlorene merowingische Königserlass nicht ausschließlich für Baiern verfügt worden, sondern durch die allgemeine Tendenz bestimmt gewesen sei, die duces in mehreren Grenzgebieten des Frankenreiches strikt dem merowingischen Königtum unterzuordnen.
Die Annahme, dass sich im Text der Lex Baiuvariorum ältere Textschichten erhalten haben, hat m. E. weitaus mehr für sich als die Annahme einer späten einheitlichen Redaktion des gesamten Textes. In der Tat verrät der Aufbau der Lex Baiuvariorum ein ordnendes, ja systematisierendes und pointierendes Bemühen, das aber keineswegs alle Uneinheitlichkeiten und Unstimmigkeiten innerhalb der offenbar unterschiedlichen Ursprüngen entstammenden Textschichten beseitigt hat. Der erste Titel behandelt ausschließlich Angelegenheiten, welche die Kirche betreffen; diese Eigenheit, welche die Lex nur mit der ihr eng verwandten Lex Alemannorum teilt, zeugt von einer erheblichen Programmatik und erinnert ein wenig an den Codex Justinianus (529/533), der ebenfalls die kirchlichen Angelegenheiten im ersten Buch behandelt hatte. In klarer Gegenüberstellung zur Kirche behandelt Titel II der bairischen Lex die rechtliche Stellung und Verantwortlichkeiten des dux. Ein kurzer dritter Titel widmet sich den herausgehobenen bairischen Adelsfamilien, ihrem Verhältnis zum fränkischen König und der Höhe ihres Wergeldes. Die weiteren Titel IV bis XXII bestehen zunächst aus langen Listen mit Kompositionsbußen und Wergeldern, wie wir sie auch aus anderen leges barbarorum kennen, behandeln aber auch Ehesachen, Diebstahl und Brandstiftung, Verfahrensfragen u. v. a. m.
Aus verschiedenen Gründen glaube ich, dass der größte Teil der Lex, vor allem die ersten beiden Titel, wohl auch der dritte, materialiter ins siebte Jahrhundert zurückreicht, während die Möglichkeit späterer Redaktionen keineswegs auszuschließen ist. Die spät einsetzende, vergleichsweise einheitliche handschriftliche Überlieferung der bairischen Lex, die nicht weiter als über das späte 8. Jahrhundert zurückreicht, spricht dafür, dass hier – ähnlich wie bei der Lex Ribuaria – eine späte Redaktion zum Ausgangspunkt großer Teile der heute erhaltenen Überlieferung geworden ist, während dieser Befund keinesfalls ausschließt, dass sich in ihm ältere Textschichten niedergeschlagen haben, deren einstige formale Eigenständigkeit noch heute erkennbar ist.
Aussagekräftig sind dabei zwei Aspekte, welche den Aufbau und die im Text verwendeten Quellen der Lex Baiuvariorum betreffen: Zum einen gibt es auffallende Ähnlichkeiten zwischen dem bairischen und dem alemannischen Recht (Pactus und Lex Alamannorum), was die Struktur und einige Bestimmungen anbetrifft; entgegen bisherigen Annahmen, dass die bairische Lex hier auf die alemannischen Rechtstexte zurückgriff, hat Harald Siems diese Übereinstimmungen jüngst auf eine gemeinsame Vorlage zurückgeführt, welche die Kompilatoren der alemannischen und bairischen Leges unabhängig voneinander benutzt haben. Zum anderen sind Einflüsse westgotischen Rechts in der bairischen lex unübersehbar, vor allem solche des heute nurmehr in Fragmenten erhaltenen Codex Euricianus, der ältesten Redaktion des westgotischen Rechts. Diese Einflüsse sind kaum zu erklären, wenn man die Entstehung der Lex Baiuvariorum in das achte Jahrhundert setzt, d. h. nach dem Fall des Westgotenreiches im Jahr 711; entsprechende Annahmen haben die Kompilation des Textes dann folgerichtig als die „Privatarbeit“ eines Gelehrten eingeordnet, der den Text in einem bairischen Kloster seinem Wunschdenken gemäß erarbeitet oder sogar, wie Clausdieter Schott annahm, im Kloster Niederaltaich gefälscht habe. Solche Hypothesen besitzen jedoch keine allzu große Überzeugungskraft. Zudem vereinfachen sie den Vorgang der Schaffung rechtsverbindlicher Normen in ganz ungebührlicher Weise, indem sie an die Stelle eines von langen Beratungs- und Konsensakten geprägten Prozesses die Phantasie eines einzelnen rechtskundigen Gelehrten setzen. Der Codex Euricianus ist Ende des 5. Jahrhunderts in Gallien aufgezeichnet worden; dass man ihn 250 Jahre nach seiner Aufzeichnung im Sinne einer freischwebenden Rezeption kurzerhand zur Redaktion bairischen Rechts verwertete, erscheint weitaus weniger wahrscheinlich als die Annahme rechtspolitischer Einflüsse zu einem Zeitpunkt, als Südgallien und Bayern gleichermaßen fest ins Merowingerreich integriert waren – was gewiss nur vor dem 8. Jahrhundert der Fall gewesen sein kann. Dass der Rückgriff der bairischen und alemannischen Lex auf dieselbe gemeinsame Vorlage anscheinend unabhängig voneinander erfolgte, lässt sich m. E. gut damit vereinbaren, dass beide Leges sich dem zeitgleich im früheren 7. Jahrhundert verfolgten Bemühen verdanken, für die beiden Dukate jeweils eine Rechtsaufzeichnung zu erstellen. In eine ähnliche Richtung verweist die offenkundige Nichtbenutzung der westgotischen Gesetzgebung der Könige Chindasvinth (642–653) und Reccesvinths (649/53–672) aus der Mitte des 7. Jahrhunderts. Ob dies auch für den langobardischen Edictus Rothari von 643 gilt, bedarf weiterer Untersuchung.
3. Das Militärrecht im “Herzogstitel” der Lex Baiuvariorum
Mit Blick auf das Militärrecht ist hier hauptsächlich der zweite Titel von Interesse. Dieser Titel war bereits eines von Heinrich Brunners Hauptargumenten dafür, dass sich hinter Teilen der Lex Baiuvariorum ein heute nicht mehr erhaltenes allgemeines merowingisches Königsgesetz verbirgt. Schon in der Überschrift zum zweiten Titel liegt ein Indiz dafür vor, dass Brunners Annahme keineswegs aus der Luft gegriffen ist. In seltsamer Grammatik handelt der Titel „Über die Herzöge und dessen Angelegenheiten, die sich auf ihn beziehen“ (De ducibus et eius causis qui ad eum pertinent). Dies klingt merkwürdig. Selbstverständlich gab es nur einen dux in Baiern, so dass kein Grund bestanden hätten, von duces in der Mehrzahl zu sprechen, wenn nicht zugleich angenommen wird, dass diese Passage ursprünglich für mehr als einen Dukat bestimmt gewesen ist und ohne weitere Anpassung in die bairische Lex übernommen worden ist; und Brunner hat eine Reihe weiterer Indizien geltend machen können, die in dieselben Richtung denken lassen. Je mehr wir im Text einen allgemeinen Erlass entdecken, dessen Bestimmungen offenkundig weit über Baiern hinausreichten, umso interessanter und aussagekräftiger wird er mit Blick auf die Frage, welche Rolle römisches Militärrecht in der organisatorischen Ausgestaltung der fränkischen Dukate spielte.
Die merowingischen Könige regelten hier den Rechtsschutz des von ihnen eingesetzten bzw. vom Volk gewählten bairischen dux, der ihnen untergeordnet war; der Titel enthält zudem einen umfassenden militärstrafrechtlichen Codex, der das Verhalten der Soldaten grundsätzlich und im Krieg bestimmen sollte. Der Text behandelt unter anderem den Aufstand gegen den Herzog (seditio), den Aufruhr (scandalum) im Heer oder am Hof des Herzogs, Plünderung und Brandstiftung auf der Heerfahrt innerhalb der Provinz (praedatio) und den Diebstahl von Ausrüstungsgegenständen im Heer. Daneben wurden Regelungen zum Schutz und besonderen Rechtsfrieden des herzoglichen Hofes (curtis ducis), Bußsätze im Fall der Missachtung des herzoglichen Banns und Zeitpunkte und Versäumnisbußen für Heeres- und Gerichtsversammlungen (placita) festgelegt; daran anschließend geht der Text zu verschiedenen Bestimmungen zur Handhabung der Gerichtsbarkeit durch den comes und die übrigen iudices über. Eine Sonderstellung nimmt die ausdrückliche Regelung des Falls ein, dass der Sohn des dux sich gegen diesen erhob; diese scheint ihre Entstehung einem konkreten Fall zu verdanken, findet sich jedoch auch in der Lex Alamannorum, ist daher womöglich auf eine gemeinsame Vorlage zurückzuführen.
Im Folgenden kann keine umfassende oder gar erschöpfende Analyse des Herzogstitels geleistet werden, der eigentlich eine durchgehende detaillierte Kommentierung verdiente. Stattdessen sollen exemplarisch einige Bestimmungen näher betrachtet werden. Die beiden ersten Bestimmungen des Herzogstitels der Lex Baiuvariorum sind allgemein gehalten und beziehen sich auf den Schutz des dux grundsätzlich:
If anyone attempts to take the life of the duke whom the king appoints to that province or whom the people themselves choose as duke, and he is convicted so that he cannot deny it, let that man and his life be in the power of the duke, and let his property be confiscated by the state. And this is not to occur as an incidental provocation, but let the proven fact reveal the truth. And let it not be proven with one witness, but with three witnesses, all of equal class. If, however, one witness testifies and another denies it, then let them resort to the judgment of God, and let them go to the field, and let God give victory to whomever is to be believed. And let his take place in the presence of the people, so no one may die through malice.
Let no free Bavarian lose his freehold land or his life [Unless punishable for] a capital offense; that is, attempting to take the life of the duke, inviting enemies into the province, or devising to seize the state (civitas) through foreign intervention. And [if] he is convicted, then let his life be in the power of the duke, and let all his property [descend] into the treasury(patrimonium). Moreover, for other offenses (peccata) that he commits, let him compensate according to the law (lex), as long as he has property. If, however, he has no property, let him be pressed into slavery, and let him serve that one whom he injured several months and years, if he was able to profit [from his act], until he restores the whole debt.
If anyone kills his duke, let his life (anima) be taken for the homicide he caused, and let his property be permanently confiscated by the state.
In der Lex Baiuvariorum war die Rechtsstellung des bairischen dux nach dem Vorbild des merowingischen Königtums als eine Art Stellvertreterschaft des Königs definiert; der König blieb zwar dem bairischen dux klar übergeordnet, doch agierte dieser in seinem Herrschaftsgebiet durchaus in großer Machtfülle. Die zitierten Bestimmungen, die enge sachliche und sprachliche Berührungen mit entsprechenden Regelungen der Lex Alamannorum zum Schutz des alemannischen Herzogs aufweisen, verbanden konkrete Sanktionen mit grundsätzlichen Klarstellungen und Rechtsbegründungen, die offenbar notwendig waren. Dazu gehörte einmal, dass das Verfahren, mit dem der Nachweis verräterischer Aktivitäten gegenüber dem dux nachgewiesen werden musste, genau vorgeschrieben wurde. Zum anderen wurde hervorgehoben, dass nur im Falle derartiger crimina capitalia Todesstrafe und Vermögenskonfiskation zulässig seien, während bei allen übrigen Vergehen das übliche Kompositionssystem zur Anwendung kommen sollte, in welchem die Bußen vor allem an die andere Streitpartei zu entrichten waren. Die Verhängung von Todes- und Enteignungsstrafen musste hier eigens begründet werden, offenbar weil es hierfür keine entsprechenden Traditionen gab, die allgemeine Verbindlichkeit hätten beanspruchen können.
Mehrere Delikte gegen den dux qualifiziert die lex als crimina capitalia und weist sie damit in der Art der Sanktionierung eindeutig einer „öffentlichen“ Rechtssphäre zu. Die zitierten Bestimmungen zum Schutz des bayrischen dux zeigen eine eigenartige Mischung von hochkomplexen Rechtsvorstellungen und einfachen Verfahrensformen. Schon der Hinweis darauf, dass die Bestrafung verräterischer Handlungen „nicht bei einer sich bietenden Gelegenheit geschehen, sondern der Beweis des Tatbestandes die Wahrheit offenbaren“ sollte (et hoc non sit per occasionem factum, sed probata res pateat veritatem), weist, worauf bereits der Herausgeber Ernst von Schwind aufmerksam machte, enge wörtliche Übereinstimmung zu einem Digestentitel auf, der die Kommentierung des römischen Juristen Modestin zur lex Iulia maiestatis enthielt. Dieser Titel hatte bestimmt, dass bei auch Infamierte, Sklaven und Freigelassene als Kläger in Frage kamen, und auch die sonst vom Recht auf accusatio ausgenommenen Soldaten, „denn wer für den Frieden wacht, der muss umso mehr zu dieser Anklage zugelassen werden“. Doch die Bezüge zum römischen Majestätsverbrechen reichen noch weiter. Bemerkenswert ist, dass die Regelungen bei Angriffen gegen Leben und Person des bairischen dux bereits die Tatplanung für in höchstem Maße strafwürdig erklärten, in dieser für den Bestand der politischen Ordnung zentralen Frage somit von höchst „unarchaischen“ Rechtsvorstellungen ausgingen. Die in der Lex Baiuvariorum betonte Strafbarkeit nicht nur des Tatversuches, sondern bereits der Planung der Tat erinnert sehr an die spätrömische Lex 'Quisquis' von 397, die genau dieses für das Majestätsverbrechen verfügt hatte. Auch die Sanktionierung dieses Vergehens und des in gleicher Weise behandelten Landesverrats durch die Doppelsanktion von Todesstrafe und Vermögenskonfiskation scheint direkt an das römische Majestätsverbrechen anzuknüpfen. Harald Siems hat unlängst erwogen, dass die Kompilatoren der bairischen Lex oder deren Vorlage auf eine Rechtssammlung zum crimen laesae maiestatis zurückgegriffen haben könnte. Diese Annahme besitzt zweifellos weitaus höhere Wahrscheinlichkeit als die von Theodor Mommsen erwogene Vermittlung der Vorstellung über einen Brief Gregors des Großen, lässt sich jedoch nicht erhärten.
Ein Gesichtspunkt, der hier vielleicht weiter führt, ist die schon von Mommsen in anderem Zusammenhang herausgestellte Tatsache, dass gerade das römische crimen laesae maiestatis sich an der Schnittstelle von ‚Staatsrecht‘ und ‚Militärrecht‘ bewegte. Aus diesem Grund umfasste es keineswegs nur Angriffe auf die Person des Kaisers, sondern auch zahlreiche „militärrechtliche“ Delikte wie Befehlsverweigerung, Meuterei, Fahnenflucht bzw. unerlaubtes Verlassen des Heeres und Landesverrat. Eine Vermittlung des römischen Majestätsverbrechens an die frühmittelalterlichen regna und in deren Dukate scheint mir daher durchaus auch im Zusammenhang militärrechtlicher Regelungen vorstellbar. Diese These lässt sich noch besser fundieren, wenn der Kontext der Bestimmungen der Lex Baiuvariorum und die in ihnen vorgesehenen Regelungsspielräume berücksichtigt werden. An das spätrömische Militärrecht erinnert auch, dass die zitierte Regelung anstelle der Todesstrafe die Möglichkeit einer Begnadigung des Täters bzw. ein arbiträres Strafmaß vorsah: der Täter und sein Leben sollten in der Gewalt des dux stehen (in ducis sit potestate homo ille et vita illius), also, wenn man so will, des höchsten zuständigen Offiziers. Die Entscheidungskompetenz hierüber war nicht in die Hände des fränkischen Königs gestellt, sondern sollte auf der Ebene des Herzogtums liegen. Das dem dux eingeräumte Recht, den Täter entweder hinrichten zu lassen oder ihn zu begnadigen, ist wohl kaum auf christlichen Einfluss zurückzuführen, das darin enthaltene arbiträre Element lässt sich auch weniger leicht auf die laesa maiestas zurückführen als auf das Militärrecht. Denn die Strafgewalt eines hohen Offiziers musste naturgemäß flexibel handhabbar sein, so dass er aus Zweckmäßigkeitserwägungen einen Tater ggf. auch begnadigen können durfte.
Eine weitere Besonderheit, die veranschaulicht, dass unter militärischen Vorzeichen andere verfahrensrechtliche Prinzipien zum Tragen kamen, bildet das beschriebene Beweisverfahren, das die offenbar für groß erachtete Gefahr möglichen Missbrauchs gering halten sollte und einen charkteristischen Abgleich unterschiedlicher Verfahrensvorstellungen erahnen lässt. Die zitierte Bestimmung der lex Baiuvariorum lässt in ihren Anklängen an die zitierte Digestenbestimmung erkennen, dass man die Gefahr für gegeben hielt, dass bei Verratsklagen gegen den Herzog Willkür über Wahrheit triumphieren konnte. Das Verfahren, das man dagegen ersann, scheint von Rechtspraktiken des Militärwesens bestimmt gewesen zu sein: Konnten die erforderlichen drei Zeugen für den Nachweis verräterischer Handlungen nicht aufgebracht werden, so sollte dieser Nachweis durch einen öffentlichen, als Gottesurteil aufgefassten Zweikampf zwischen Zeugen und Beklagtem erbracht werden. Dies wurde als praktikable und zuverlässige Beweisform in einer Lebens- und Rechtssituation angesehen, die komplexere Methoden der Wahrheitserforschung offensichtlich nicht immer zuließ. Beruhte die Definition der Tatbestände in den militärrechtlichen Bestimmungen in den bairischen und alamannischen leges also noch auf entsprechenden Regelungen des römischen Majestätsverbrechens, so präsentieren die Rechtsaufzeichnungen ihre Bestimmungen in einer entsprechend den veränderten Realitäten im Frankenreich modifizierten Form.
In der Lex Baiuvariorum begründeten Delikte, die als verräterisch eingestuft wurden, eo ipso eine weitaus schärfere Sanktionsgewalt als gewöhnliche Tötungsdelikte. Auch der Landesverrat (proditio patriae) gehörte zu den gravierenden Delikten, mit deren Verübung man vornehmlich im Bereich des Heeres rechnete. Auch im spätrömischen Militärrecht sind diese Regelungen fassbar. So sollte nach dem Strategikon des Mauricius „derjenige, dem die Bewachung einer Stadt oder einer Festung anvertraut wurde und der sie daraufhin übergeben oder gegen den Befehl des Kommandanten von dort abziehen sollte, der Todesstrafe verfallen sein“. Die zitierte Bestimmung der Lex Baiuvariorum fasste es dementsprechend als crimen capitale auf, Feinde ins Land zu rufen oder darauf hinzuarbeiten, dass eine Stadt (civitas) von Fremden eingenommen würde. Und in der verwandten Lex Alamannorum wurde demjenigen homo, der ein fremdes Volk zu Plünderung und Brandstiftung ins Land rief, mit dem Tod oder mit der „Verbannung, wohin der Herzog ihn schicken mag“, sowie mit der Konfiskation seines Vermögens gedroht. Auch hier begegnen erneut die beiden aus der Tradition des crimen publicum bekannten Sanktionen, wobei die Abmilderung der Todesstrafe in Verbannung wieder unverkennbar ein arbiträres Element zeigt.
Auch in der Trennung zwischen verräterischen und nicht verräterischen Delikten setzt sich mittelbar eine Tradition des römischen Heeres fort, denn in römischer Zeit galten Desertion und Überlaufen zum Feind stets als Bruchs des Fahneneides, wohingegen Wachtvergehen und geringere Verstöße als Disziplinarvergehen geahndet wurden. Eine andere Unterscheidung, die sich auf die Sanktionen gravierend auswirkte, war diejenige zwischen im Kriegszustand (d. h. auf der Heerfahrt) und im Friedenszustand verübten Vergehen. Die Lex Baiuvariorum behandelte den Aufstand (seditio, auch scandalum in provincia, altbairisch carmulum) gegenüber dem Herzog getrennt vom Aufruhr im herzoglichen Heer (scandalum in hoste) und bediente sich dabei einer Unterscheidung, die bereits im römischen Recht begegnet. Beide Delikte waren möglicherweise bereits im spätantiken Verbot der coniuratio inbegriffen, das gleichermaßen als politisches Delikt wie im Bereich des Militärs verfolgt wurde. Nach der bairischen lex waren in beiden Fällen die (offenbar als standeserhöht gedachten) Anstifter mit einer Geldstrafe von 600 solidi zu bestrafen, wobei Mittäter einer seditio 200 Schillinge und freie Mitläufer aus dem niederen Volk (minor populus) 40 Schillinge zahlen sollten.
Davon abweichend wurde für den Aufruhr im Heer (scandalum infra hostem) ausdrücklich bestimmt, dass neben der zu zahlenden Bußsumme König und Herzog das Recht haben sollten, Strafen nach eigenem Ermessen zu verhängen:
If anyone in the army that the king or the duke appoints in the province stirs up a quarrel (scandalum) within his own band, and men are killed there, let him compensate with 600 solidi to the state (in publico). And whoever causes beatings (percussiones) or injuries (plagae) or commits homicide (homicidium) there, let him compensate each according to his class (secundum suam genealogiam), just as the law (lex) requires. And let a man who does this extol the king or his duke as merciful as he grants him his life. Concerning lesser men (minores homines), however, if they stir up a quarrel (scandalum) in the army, let it be in the power (potestas) of the duke [to decide] which punishment (poena) they are to endure. For this practice must be eradicated, so that it does not occur. A quarrel frequently rises, in fact, over horse fodder or firewood, since some [soldiers] are assigned to defend farm buildings and barns, where hay and grain are found. This [disagreement] is forbidden so that a quarrel (scandalum) does not occur. If anyone finds fodder (pabulum) or firewood (ligna), let him take what he wishes, and let no one be prevented from taking [what he wants], so that a quarrel (scandalum) may not occur because of this. If anyone dares to do this and opposes this in some way that the law forbids, then let him, if he is discovered, be liable to military law in the presence of the duke (coram duci) or before his count (ante comiti suo); that is, let him receive fifty lashes (percussiones).
Die Bestimmung berücksichtigte beim Aufruhr im Heer die Schwere und die Folgen des Vergehens. War es dabei zu Todesopfern gekommen, sollte der Täter neben einer hohen öffentlichen Geldbuße das Wergeld an die Hinterbliebenen des Opfers zahlen und die Entscheidung über sein Leben in der Gewalt des Herzogs oder König liegen. Erneut begegnet hier also die arbiträre Strafgewalt des obersten Feldherrn, wobei die Tatsache, dass die Gewalt des bairischen Herzogs ausdrücklich mit derjenigen des Königs in Verbindung gebracht wurde, unterstreicht, dass es sich letztlich um Reichsrecht handelte, das hier mutatis mutandis die Rechtsverhältnisse im bairischen Dukat auf eine verbindliche Grundlage stellen sollte. In seinem Bezug auf die genealogiae, die im folgenden dritten Titel der Lex behandelt werden, wird zudem deutlich, dass diese beiden Titel als in einem Zusammenhang stehend gesehen worden sein müssen.
Der zweite Teil der Bestimmung galt einem von minores homines erzeugten Aufruhr und fiel ganz in die Zuständigkeit des dux bzw. des ihm unterstellten comes, denen in diesem Fall ebenfalls die Verhängung der Strafart anheimgestellt wurde. In moralisch-belehrender Diktion wurde eingeschärft, dass bei der Suche nach Pferdefutter und Brennholz keine schweren Konflikte entstehen dürften: ille usus eradicandus est, ut non fiat. Ausdrücklich ist von einer vom Herzog oder dem zuständigen Grafen zu vollziehenden militärrechtlichen Strafe (disciplina hostilis) die Rede, die in der Erteilung von 50 Hieben bestand. Die zitierten Regelungen verweisen explizit auf ein besonderes militärisches Strafrecht, das schon begrifflich an die römische disciplina militaris anklingt, aber ebenso in der angedrohten körperlichen Züchtigung (Schläge, eventuell Peitschenhiebe) an das römische Militärstrafrecht erinnert.
Ein anderes militärrechtliches Delikt, welches die Lex Baiuvariorum erwähnt, ist die „Verheerung“ (heriraita), die genau von der „Heimsuchung“ (heimzuht) unterschieden wurde. Beide Delikte bezeichneten bewaffnete Übergriffe auf Höfe (curtes) mit Schilden, Pfeilen und anderen Wurfgeschossen in der Absicht, einen freien Mann zu umzingeln. Den Unterschied markierte hier die Anzahl der am Übergriff beteiligten Mittäter: Von einer „Verheerung“ konnte demnach erst die Rede sein, wenn der Angriff mit 42 Schilden erfolgte; bei jeder darunter befindlichen Mittäterzahl sprach man von einer „Heimsuchung“. Unterschiedlich war entsprechend die Sanktionierung: während den Haupttäter im Fall der „Heimsuchung“ eine Bußsumme von 12 solidi treffen sollte, wird die besondere öffentliche Qualifikation des Verheerungsdeliktes daran deutlich, dass die erhöhte Bußsumme von 40 Schillingen nicht nur an die geschädigte Seite, sondern daneben auch an den Herzog zu entrichten war. Die Verheerung erfolgte mit bewaffneter Schar (hostili manu, collecta manu, manu armata, exercitus), der am häufigsten verwandte lateinische Terminus zur Kennzeichnung solcher Truppen war collectae. Dabei zeigt schon der in der Lex Salica im selben Zusammenhang gebrauchte Begriff collecto contubernio und die deutlich erhöhte Sanktionierung der von diesen begangenen Tötungsdelikte in Lex Salica und Lex Ribuaria, dass hier insbesondere an reguläre militärische Einheiten zu denken ist, die in diesem Zusammenhang eingesetzt wurden. Derartige collectae betrieben neben ihren eigentlich militärischen Aufgaben Handlungen fehdeartiger Justiz, die die fränkischen Könige unter dem Tatbestand der harizuht zu bekämpfen suchten. Unter Karl dem Großen wurde kurz nach 800 das Unterlassen jeglicher harizuht ausdrücklich in die Treupflicht aufgenommen: Seine Missachtung rechnete man nachfolgend neben Brandstiftung, Frauenraub und anderen Vergehen zu den acht Bannfällen, die in den verschiedenen leges verankert wurden.
Der Kontext der disciplina militaris wird noch deutlicher in der folgenden Bestimmung zur gewalttätigen Plünderung und Brandstiftung durch das Heer ohne ausdrücklichen Befehl des Herzogs:
If anyone in the army wishes through hostility to plunder the province without his duke’s order, or to take hay or grain or burn buildings, we forbid this totally, and it is not to occur. And hereafter let a count be careful [of its happening] in his retinue; in fact, let him give order (ordinatio) to his hundred-men and ten-men, and let each one watch over the troops that he commands so they do not act contrary to law (contra legem). And if anyone does this audaciously, it [the act] is to be examined by the count whose man does it (cuius homo hoc fecit). And if the count neglects to enquire who does this, let him restore all things from his own property; nevertheless, let him have time to investigate. And if such a powerful man does this that a count cannot restrain him (destringere non potest), then let him tell his duke, and let the duke restrain him according to law (distringat secundum legem). If he is a freeman, let him owe forty solidi, and let him restore all things with equal value. If a slave does this, however, let him be sentenced to capital punishment. Let his master, however, restore all things equall, since he did not forbid his slave to do such things. If you devour one another, you will perish quickly. Nevertheless, le a count not neglect to watch over his army, so that it does not act contrary to law (contra legem) within his province.
Das Problem wird bereits im frühesten Erlass König Chlodwigs angesprochen, der im Jahr 507 vor dem Feldzug gegen die Westgoten angeordnet wurde. Gregor von Tours hat später Plünderungen durch das fränkische Heer König Gunthrams in alttestamentlichen Szenarien beschrieben, und auch die Lex Baiuvariorum fand drastische Worte zur Bekämpfung des Übels: „Wenn ihr euch selbst auffresst, geht ihr schnell zugrunde“.
Der bairische Text zeigt bei der Bekämpfung derartiger Plünderungen die gesamte – ihrer Herkunft und Terminologie nach spätrömische – Militärhierarchie vom dux über den comes bis hinunter zum centenarius und decanus im Einsatz, von denen jeder „die Seinen“ (sui), d. h. die ihm unterstehenden homines, beaufsichtigen und dabei gegebenenfalls seine militärische Zwangsgewalt anwenden sollte. Bei bei dem hierfür verwendeten Verb distringere handelt es sich erneut um einen Terminus, der seine Wurzel im römischen Militärstrafrecht hat und der in fränkischer Zeit als districtio passenderweise mit dem Wort bannus wiedergegeben bzw. kombiniert wurde.
Der comes nahm hier eine zentrale Stellung ein: Ihm fiel die Aufgabe einer entsprechenden Anordnung (ordinatio) zu, er hatte etwaige Delikte zu untersuchen (inquirere) und festzustellen, um wessen Mann es sich bei dem ertappten Täter handelte (cuius homo sit). Der antiken Tradition entsprach die Vorstellung, dass der comes bei Vernachlässigung dieser Untersuchungspflicht mit seinem eigenen Vermögen haften sollte. In diesem Falle oder wenn es sich bei den Tätern um zu mächtige Leute handelte, sollte der dux einschreiten und den Täter rechtmäßig zwingen (distringere). Freie Täter waren mit einer Buße von 40 Schillingen zu bestrafen und hatten den entstandenen Schaden zu ersetzen; Unfreie – von denen es im bairischen Heer viele gegeben haben muss – sollten mit dem Tod bestraft werden, während ihr Herr für den entstandenen Schaden haften sollte.
Doch begegnen auch hier terminologische Unterschiede zum römischen Militärrecht, insofern die Soldaten jetzt nicht mehr als milites, sondern einfach als homines bezeichnet wurden. Es ist nicht auszuschließen, dass dies auf eine Entprofessionalisierung schließen lässt, doch wichtiger erscheint, dass dieser Begriff die – gerade in einem Dukat relevante – Frage der allgemeinen Militärdienstpflicht reflektierte. Überdies konnte der offenere Begriff homines („Männer“) auch die Unfreien umfassen. Zudem war der Begriff homo stärker politisch aufgeladen, wie nicht zuletzt die Formel des allgemeines Treueides zeigte, in dem die erwachsenen freien Männer – nicht zuletzt mit Blick auf von ihnen zu leistende Militärdienste – dem fränkischen König versprachen, ihm „Treue nach Art von leudes“ (fidelitas et leudesamio) zu zeigen oder ihm treu (fidelis) zu sein, „wie ein Mann von Rechts wegen seinem Herrn zu sein hat“ (sicut homo suo domino per drictum esse debet). Die Begrifflichkeit der bairischen Bestimmung scheint hieran anzuklingen, auch wenn der Begriff der Treue in ihr keine zentrale Rolle spielte.
Gerade das weitgehende Fehlen der Kategorie der Treue in der bairischen Lex erscheint bemerkenswert. Die Lex Baiuvariorum dokumentiert einen Rechtszustand, in dem die Unterordnung der Herzöge unter den König als selbstverständlich vorausgesetzt und daher auch die Treue der duces gegenüber dem König betont wird. Doch die Bevölkerung des bairischen Dukates war ihrem dux gegenüber allem Anschein nach nicht zur Treue verpflichtet, sondern lediglich zum militärischen Gehorsam. Dies ist notgedrungen ein argumentum e silentio, doch fällt immerhin auf, dass die angeführten Beispiele aus den bairischen und alemannischen leges Angriffe gegen das Leben der Herzöge nicht als infidelitas werteten. Es liegt nahe, dies darauf zurückzuführen, dass die freie Bevölkerung dieser Gebiete zu der Zeit, als die leges aufgezeichnet wurden, den fränkischen Königen, nicht jedoch den Herzögen eidlich zur Treue verpflichtet war. Dieser Befund ist wichtig, insofern die fränkischen Herrscher ja gerade im Infidelitätsdelikt wesentliche Elemente des römischen Majestätsverbrechens absorbierten, indem sie diese auf die Rechtsgrundlage des allgemeines Treueides stellten. Der Treueid war es auch, der es den merowingischen und karolingischen Koenigen ermöglichte, die in ihrer Person konzentrierte Rechtsgewalt an ihre nach militärischen Rangklassen geordnete Ämterhierarchie über das Instruments des Banns zu delegieren. Unter dieser Voraussetzung wurde es möglich, das Majestätsverbrechen, welches ja ohnhehin nicht nur Angriffe auf die Person des Herrschers betraf, sondern unterschiedliche militärische Vergehen einschloss und auch die höchsten Funktionäre schützte, sinnvoll auf die Befehlsgewalt militärischer Funktionsträger wie der duces zu beziehen. Zeigt sich hier erneut, wie eng die Rezeption des römischen Majestätsverbrechens und das Infidelitätsdelikt miteinander verbunden sein konnten, so lassen die Regelungen im Dukatstitel der Lex Baiuvariorum erkennen, wie sich diese Rechtsvorstellungen, die offenkundig zuerst mit Blick auf das Königtum rezipiert worden waren, in die administrative Routine einer Grenzprovinz übertragen ließen.
4. Vom römischen Militärrecht zum Dukatstitel der Lex Baiuvariorum
Bei der Untersuchung der Rezeption und Aneignung spätrömischen Militärrechts im frühmittelalterlichen Baiern wurde zwischen dem allgemeinen historischen Kontext der Errichtung des Dukates Baiern und dem Niederschlag solcher Elemente im Text deutlich getrennt. Dies gründet nicht nur in den Datierungsunsicherheiten, die mit der Lex Baiuvariorum verbunden sind, sondern auch in der Methodik, nicht allgemeine historische Befunde von vornherein mit textuellen Beobachtungen zu vermengen. Gleichwohl ging es darum, einen regionalen Kontext aufzuzeigen, in dem die Bestimmungen der bairischen Lex Sinn ergeben, und dieser war vor allem durch die fränkischen Interessen in Baiern gegeben.
Was den Entstehungskontext des bairischen Dukates anbetrifft, so ist vor allem die in von der jüngeren Forschung herausgearbeitete deutlichere Anlehnung an provinzialrömische Vorgängerstrukturen betont worden, die eine regional verschiedene Integration römischer Elemente in den bairischen Dukat anzunehmen nahelegt. Festungen, Straßen, Fiskalgüter usw. ließen sich so gesehen von den nachrömischen Herrschern und ihren militärischen Eliten in das neue Funktionsgebildes des bairischen Dukates integrieren. Aus diesem Grund finden wir beispielsweise das voraussetzungsreiche römische Konzept der via publica in der Lex Baiuvariorum. Munera publica wie paraveredus, angariae usw. sind dem hinzuzufügen, auch wenn man sie ihm Frühmittelalter als servitia publica bezeichnete und die Leistungen bestimmter Gruppen immer häufiger kirchlichen Einrichtungen übertragen wurden, wie nicht zuletzt das sog. „Kolonenstatut“ der Lex Baiuvariorum bezeugt.
Eine solche regionalgeschichtliche Perspektive kann indes nur einen Hintergrund bilden, um sich für die Komplexität und Selektivität der in den Rechtstexten behandelten Probleme zu sensibilisieren. Denn besteht auch kein Zweifel daran, dass die Lex Baiuvariorum für Baiern bestimmt war, so ist doch keineswegs als sicher anzunehmen, dass sie in Baiern von einem Baiern aufgezeichnet wurde. Die frühmittelalterliche Baiuvaria war eine Grenzregion des fränkischen Großreiches, und innerhalb dieses Reiches fanden die rechtlichen Rezeptions- und Aneignungsprozesse statt, die ihren Niederschlag im Text der bairischen Lex gefunden haben. Im Ergebnis kann man ein Nebeneinander unterschiedlicher Rechtseinflüsse konstatieren, die durch die ordnende Hand der Kompilatoren in ein Ganzes integriert wurden, ohne dass der Text insgesamt doch so weit homogenisiert worden wäre, dass man die verschiedenen Vorstufen nicht noch erkennen könnte.
Die zitierten Bestimmungen aus dem Dukatsstatut offenbaren die “inkonsequente” Flexibilität der militärrechtlichen Praxis, die sich dem Zweck unterordnete, die militärische Disziplin aufrechtzuerhalten und die Armee einsatzbereit zu halten. Gerade die vielfach zu beobachtenden arbiträren Elemente zeigen, wie man suchte, rechtliche Erwägungen mit praktischen Bedürfnissen in Einklang zu bringen. Auf der anderen Seite belegt gerade die scharfe Trennung zwischen Verratsdelikten und anderen Delikten, die mit Geldbußen sanktioniert waren, und zwischen im Kriegs- und im Friedenszustand begangenen Delikten, welches die entscheidenden Definitionslinien waren, die es in einem Dukat möglichst klar zu ziehen galt. In dieser Sicht erweist sich die Lex Baivariorum als ein aussagekräftiger Text, der vor allem die Andersartigkeit der Dukate und des in ihnen gehandhabten Rechts gegenüber anderen Leges des Frankenreiches zeigt.
Anders als für bestimmte andere Teile der Lex Baiuvariorum kann man für die im Herzogstitel nachgewiesenen militärrechtlichen Elemente nicht ohne weiteres eine eindeutige schriftliche Quelle namhaft machen. Eine Art „Mantelerlass“ für sämtliche fränkische Dukate, wie sie These vom merowingischen Königsgesetz anzunehmen nahelegt, wäre zwar nicht ohne spätrömische Vorläufer, aber entsprechende Regelungen der oströmischen Kaiser Anastasius I. (491–518) und Justinian I. (527–565) scheiden als direkte Vorlage des merowingischen Königsgesetzes zweifellos aus. Doch woher haben die fränkischen Könige die militärrechtlichen Regelungen genommen, aus welchen Texten könnte ein solches Königsgesetz womöglich komponiert worden sein? Angesichts der sonst zu beobachtenden textuellen Anleihen, aber auch aufgrund der Parallelen zur Lex Alamannorum ist davon auszugehen, dass es hier nicht um mündliches Gewohnheitsrecht geht, sonden um die Rezeption von Rechstetxten. Der militärische Kontext des Dukates und der in der Lex Baiuvariorum enthaltenen Bestimmungen lässt dabei vielleicht weniger an eine mögliche Rechtssammlung zum römischen Majestätsverbrechen denken als an ein Dossier militärrechtlicher Texte, welches die Frankenkönige nutzten, um für ihre östlichen Dukate eine Art Rahmen zu geben, welchen sie dann jeweils für die individuellen Dukate noch speziell ausgestalten, z. T. mit volkssprachlichen Begriffen übersetzen ließen. Das lässt sich naturgemäß nicht sicher beweisen. Berücksichtigt man das Spektrum der sonst in der bairischen Lex nachweisbaren Quellen, so erscheint es zwar keineswegs ausgeschlossen, doch eher wenig wahrscheinlich, dass die merowingischen Herrscher direkt auf statutenartige Sammlungen römischen Militärrechts zurückgegriffen haben. Solche sind zwar bezeugt und zirkulierten offenbar weiträumig – wie das Strategikon des Maurikios zeigt, in dem sich ältere lateinische militärrechtliche Traditionen niedergeschlagen haben – aber es sind vor allem die zahlreichen in der Lex Baiuvariorum nachweisbaren Anleihen aus dem westgotischen Recht, welche die Annahme wahrscheinlicher machen, dass die Franken hier auf einen in Gallien entstandenen westgotischen Text zurückgegriffen haben (bzw. auf einen Text, der seinerseits darauf zurückgriff). Bereits Karl Zeumer hatte die Vermutung geäußert, dass die Verratsbestimmungen der Lex Baiuvariorum und ähnliche Regelungen, die im langobardischen Edictus Rothari zu finden sind, auf eine gemeinsame westgotische Vorlage zurückzuführen seien, also „aus dem alten Westgotenrecht“ geschöpft hätten, welches erst König Reccesvinth dann im 7. Jahrhundert außer Kraft setzte. Das wenige, was vom einstmals sehr umfangreichen Codex Euricianus heute noch erhalten ist, erlaubt allerdings kaum Aussagen zum westgotischen Militärrecht der Zeit, auch wenn erhaltene Bestimmungen zum patrocinium und zu den Bucellariern die Vermutung stützen, dass in Eurichs Codex ursprünglich wesentlich mehr zu militärischen Rechtsfragen gestanden haben dürfte als die wenigen Fragmente heute noch erkennen lassen. Im minutiösen Vergleich der Lex Baiuvariorum mit ihren westgotischen Quellen und Parallelen hat Isabella Fastrich-Sutty zahlreiche wichtige Erkenntnisse zur Arbeitsweise der Kompilatoren zu Tage gebracht hat, doch gerade für das Dukatsstatut der bairischen Lex vermochte sie kaum westgotische Parallelen aufzuzeigen. Allerdings ist die Zahl möglicher zu berücksichtigender Parallelen in diesem Bereich offenbar doch größer als bisher angenommen wurde.
Möglicherweise stößt die Methode des strengen Textvergleiches im Fall des Militärrechts jedoch auch an ihre Grenzen. Gerade die Flexibilität des Militärrechts in den zu verhängenden Sanktionen riet womöglich einer allzu rigiden Übertragung der in der möglichen Vorlage genannten Sanktionen auf entsprechende Delikte in die Lex Baiuvariorum entgegen. Wichtig für die Nachwirkung und Rezeption des römischen Militärrechts in der Lex Baiuvariorum war, dass nur bei besonders schweren Delikten Sanktionen wie Todesstrafe und Konfiskation vorgesehen waren, während in der variablen Handhabbarkeit der meisten Sanktionen das eigentlich interessante Element erscheint. Abstract: This paper investigates the influence of Late Roman military law on the Lex Baiuvariorum – a text, which served as the basis for the Merovingian kings’ organization of the Frankish kingdom’s eastern border-region as a ducatus or duchy. Particular considerations concerning the historical background of the Bavarian duchy’s formation will be addressed, after which provisions for the protection of the Bavarian dux or duke, largely as relates to treason and military discipline, will be investigated. By comparing sources for the Roman crimen laesae maiestatis and other legal texts of Roman military writers, it will be demonstrated that the provisions of the Bavarian Lex clearly bear the influence of Roman military law. In particular, the arbitrary punishments, which the duke was permitted to impose in the case of severe disciplinary (and other) offenses, suggest that possible processes of adoption and appropriation were driven by military rather than constitutional law. This study takes from the position of Heinrich Brunner in explaining this Roman influence, namely that a general decree, traced to the Merovingian Kings Clothar II and/or Dagobert I of the early 7th century, is reflected in the Bavarian duke’s statute (or title on the role of the duke). The original decree, which informed the extant title, did not initially apply to Bavaria; rather, it was intended to provide the Frankish duchies with a functional legal framework. The elements of military law found in the Lex Baiuvariorum are thus, as is ultimately conjectured, the direct or indirect result of legal texts originating in post-Roman Gaul, which had themselves been heavily influenced by Roman law. These texts, by informing the duke’s statue in the Lex Baiuvariorum, are thereby responsible for transmitting the influence of Roman military law into the Bavarian context.
The study of the Leges barbarorum, by which name the Early Medieval codes of ‘folk’ or ‘people’s law’ have been known for some time, is part of a long historiographic tradition that was not infrequently conducted in the service of masterful, national-historical narrations. Since the Second World War, the study of these texts has made new headway, however. Four contemporary discussions are worthy of mention – discussions that touch at the core of the generic term Leges barbarorum: Firstly, (1) the discovery of Late Roman Vulgar law and its incorporation into the legal codifications of the Early Middle Ages assisted in overcoming the stark dichotomy between “Roman” and “Germanic” law. Since then, a more fluid transition from the law of Antiquity to the law of the Early Middle Ages has been adopted. In the meantime, the extent of the “vulgarization” of Late Roman law, as well as the precise term “vulgarization” or “vulgarism”, remains disputed. Yet a lasting and important recognition is to be found here, namely that the respective Roman-provincial context has now become important when considering possible continuity and adaptation of Roman legal practice(s). Furthermore (2), the debate waged since the 1970s on the role of the written word in Early Medieval legal life, with a focus on the Leges barbarorum, has posed the question as to the functionality and practical application of these texts and their relationship to oral legal practice or customary law: Thus, the regulatory intention of individual leges has been understood in many different ways. For this reason, the symbolic significance of the leges, beside the question of application or non-application in court, has been emphasized. Additionally, the techniques guiding the leges’ composition and the usage of written models therein have been touched on to a greater extent. Due to these findings, including an extensive investigation of the medieval concept of law, the assumption that one could capture “Germanic law” (if such a thing existed), by its nature, in these legal codes has been (3) fundamentally called into question. Instead, the attempt is increasingly made to contextualize the leges through other legal texts that originated or were available for study at the same time. And finally (4), the comparative perspective on various texts has made it quite clear that the umbrella term Leges barbarorum is to be classified, if anything, as hardly an explanatory tool; for these texts (hereby included) are far too different. Clearly, too diverse of regulatory concerns had determined the different compilations and later redactions of such texts in the Middle Ages. The compilation of multiple leges into aggregate manuscripts – as they are preserved in compositions largely different from the Carolingian period – must thus be understood as the attempt to provide entirely distinct texts with a new, common administrative and “ideological” purpose, according to the origins and objectives of such texts. Similarly, the codification of new leges and the revision of those already in existence, as inaugurated under Charlemagne and Louis the Pious, must be understood first and foremost as originating from the legal-political objectives of the time.
For these reasons, the term Leges barbarorum, for the pre-Carolingian period, no longer promises many new insights, if used as a generic or umbrella term. This is all the more important to stress, in that important progress is achieved in the subject matter of these texts, such as relates to family and inheritance law, to commercial law and religious offense, to procedural law and penal law, as well as to a system of fines (to name only a few of the most important areas addressed); comparative studies on law and leges thus remain relevant. However, in light of liberation from the concept of “Germanic law” and the renunciation of a substantive, well-founded coherence of terms, the opportunity presented here should be seen and received – that is, an opportunity to contextualize individual texts in a much more novel, complex fashion, both historically and in legal history.
For some time now, a new field is being increasingly unlocked – a field, upon which the transition from antique law to Early Medieval law is presented as fluid. Furthermore, this field promises clear gains in insight from many of the texts aggregated under the term Leges barbarorum, namely the influence of Late Roman military law on the law and political organization of the post-Roman kingdoms. As all gentes – who, since the 5th century, managed to establish kingdoms (regna) in Late Roman western territory – served as Roman federates (foederati) in Late Antiquity and, as such, were inaugurated under the Roman emperor and put under the authority of Roman officers, the presumption of extensive influence of Roman military law has merit from the outset. A few aspects of Early Medieval law have been previously combed for the imprint of Roman military law. One such aspect is the significance of the oath of allegiance, influenced by the Roman military oath (sacramentum militare), upon which the legal concepts of fidelity, payment of homage , and the royal ban are founded. Related aspects include particular forms of punishment, the connection between military authority and civil authority in the hands of the comites, the problem of compulsory military service – as referenced in different leges – the possession and succession of military lands, and so on.
Most of these findings are of necessary selective form; the reconstruction of Roman military law is already a particularly arduous endeavor. For – aside from related juridical annotations De re militari in the Principate (Tarruntenus Paternus, Arrius Menander), such as concerned breach of duty, marriage law, and soldiers’ property, as periodically quoted in the Digests – attempts to assemble this legal material into systematic compilations first occurred in the Late Roman period. The laws of the Empire, collected in the Book VII De re militari of the Codes Theodosianus, address important questions – above all, questions of military organization and administration. Little mention is made of soldiery codes of conduct, however. On the other hand, various texts, stemming partly from legal practice, do include provisions for matters of military law, of which temporal classification and authorship remain somewhat disputed. The most important of these is the Strategikon, attributed to the Roman emperor Maurice (582-602) and written in Greek, in which regulations pertaining to military law can be traced back to older regulations written in Latin. The ability to precisely trace influences of Roman military law is made even more difficult by the fact that much of that, which was incorporated, was customary law, thus largely unwritten. Additionally, military penal law was frequently characterized by an inconsistent execution that, per definition, was not possible to codify in detail.
In regards to the legal records of the Early Middle Ages and their formation by way of Roman military law, one must account for the way in which the influence on individual leges could vary so strongly, according to the conditions of the individual lex’s origination, the various contexts of its function, and its determined aims. Thus doubt has recently been raised, with good reason, on whether it is sensible to address the bulk of the provisions of the Lex Salica – as has been suggested – as “military law”. Additionally, it is necessary to mention that references to military law are much easier to trace in the later lex – the Lex Ribuaria, written for the Rhineland population in the 7th century – than in the earlier Lex Salica, despite this text having served, in part, as an integral model for the Lex Ribuaria.
Aside from such distinctions between texts, the term “military law” itself – a term certainly inclusive of many different things – requires a clarification of its spectrum of meaning and the consistency of those regulations that fall under this term. Does “military law” refer to martial law or does it include the authority of military commanders over the population, and not only within the military’s realms of regulatory influence? To what extent does it extend to the ordinary lives of soldiers? Does it apply to the regular army or to members of the population living in colonies, or other military settlements with their families – those who lived separate from their immediate environs? And did not such military law – as is of interest in regards to those groups affected by Roman military law – reflect the differences between troops of the field army (comitatenses), the frontier armies (limitanei), and the federates (foederati), respectively? Even if the further development and late renunciation of Late Roman practice in the Early Middle Ages is taken into consideration, questions such as the following seem anything but marginal: What is the meaning of “military law”, given the fact that the separation between military and civil administration was relinquished in the Early Middle Ages, and that military commanders were increasingly charged with juridical tasks? And what were the consequences of seeing the free, male population principally compelled to military service, as had been the case since the 6th century in many post-Roman regna, thereby effectively militarizing the entire population? Which branches of political and societal life were included to a greater extent in the norms of military law, and which to a lesser extent, if even at all? How did the character of “military law” change, as a shift from a sectorally applied system to an increasingly more “general” system of law, which fulfilled the functions of governance and conflict settlement within a political hierarchy gradually taking root?
In the context of this sketch of a double-edged problematic, concerning the research of the Leges barbarorum, as well as of the adoption of Roman military law, the following paper has a rather restricted aim. Focused on individual legal codifications, the Lex Baiuvariorum will be analyzed for influence of Roman military law, – which has yet to be investigated in-depth - being careful not to take the umbrella term Leges barbarorum as the point of departure. Instead, (1) the historical context in which the Lex Baiuvariorum emerged with the Frankish duchy of Bavaria, as well as (2) the intended realm of application of the Lex Baiuvariorum, will be more closely outlined. Next, selected examples of verifiable influences of military law will be extracted from the text of Lex Baiuvariorum itself – those passages that in many ways bear a Roman imprint. In closing, the question as to possible sources of military law and their translation into and transmission in the Early Middle Ages will be addressed (4).
1. The Merovingian Duchy of Bavaria
Baiuvaria does not denote an ancient geographical region but one of the Early Middle Ages. Even the Baiuvari – the inhabitants of the region – do not appear in our sources before the 6th century. Since the Bavarians are clearly not an old Germanic tribe, it makes sense to move past the question of their ethnic origin and identity, in dealing with the Bavarian duchy. Indeed, it is wise to begin with the particular region, which has been referred to as Baiuvaria since the Early Middle Ages and was arranged by the Franks into a duchy. This latter event took place in the late 530s, likely around the years 537/538, according to the some historians. Thus the formation of the Bavarian duchy aligns with the Eastern Roman reorganization of military and provincial structures in the Balkans, begun around 535 as part of Justinian’s plans to push the Ostrogoths out of Italy. Under pressure, the king of the Ostrogoths, Witigis, surrendered the Ostrogoth-controlled regions of “Northern Italy” to the Franks. These regions had originally belonged to the Italian prefecture. As a result of this move, the Franks became the new rulers of the Alpine region. Justinian’s reaction is not explicitly recorded, though one could conclude, as analogous to his recorded agreement with the Ostrogoth secession of Provence to the Franks in the year 536, that a complete change of power was the issue at hand, legitimized by the Eastern Roman emperor. Ian Wood has even suggested that East Roman consent to the expansion of Frankish territory could have included Burgundy, which the Franks had previously annexed in the year 534. At that, it is appropriate to add that the Franks had, immediately prior, eliminated the kingdom of Thuringia, giving way to the formation of a Thuringian duchy. Additionally, the Frankish-Lombard marital alliance between Theudebert I and Wisgarde had already aided in securing the new landscape. This development also pertained to the new conditions for the formation of the Bavarian duchy, as in the corresponding establishment of the adjoining Alemannic duchy. For this reason, the years between 533 and 538 appear a period of momentous change to the north and the south of the Alps. What occurred during this time in Bavaria was thus most likely anything but a purely local matter; instead, it was part of a much larger Frankish attempt to induce a new political order of its eastern territory of the Frankish kingdom, in agreement with East Rome. This order was eloquently expressed in a letter from Theudebert I to Justinian, written in 534 or shortly thereafter, as well as in a letter from Justinian transmitted to the Frankish kings by Procopius. The invasion of Northern Italy by the East Frankish King Theudebert, setting in as early as 539, appears to have anticipated this new order.
Aside from serving as the foundation for plans of expansion, Bavaria, in its function as a Merovingian duchy, largely helped to defend and secure the eastern and southeastern borders of the Frankish kingdom. The region was primarily composed of the territories of two Roman provinces, Raetia Secunda and Noricum ripense. The Franks took charge of these regions, establishing a military administration for the new border region under the control of a dux. This is of particular significance, because the Bavarian duchy was, in all likelihood, not the direct and seamless continuation of an antique ducatus. There was indeed a dux Raetiarum in the Late Roman and Ostrogothic period, but his function was to defend the northern border of the Roman Empire and, later, the northern border of Ostrogothic Italy. However, the two former Roman provinces, incorporated into the Bavarian duchy during the Merovingian period, had thus become part of the Frankish kingdom’s southern and southeastern lines of defense. In other words, the region, which had once formed the northern territory of the Roman Empire, went on to form the southern border region of another kingdom. But what were the implications of this geographical shift?
An important topic in the most recent research is the question as to the location of the “headquarters” of the Bavarian duchy of the Early Middle Ages, i.e. where the duke held his residence and from where the duchy’s military and administrative tasks were conducted. For quite some time it had been assumed that, for the complete duration of the Bavarian duchy, Regensburg, the former Roman castra Regina, had been its capital. While there is no doubt that Regensburg served as the seat of government for the Agilolfing dukes throughout the 7th century, Arno Rettner recently argued that Augsburg (Augusta Vindelicorum) may have, in fact, been the base of the Bavarian dux in at least the 6th and early 7th century. If Rettner’s theory is correct – which seems plausible to me – then a different light is to be cast on the entire process of the Bavarian duchy’s origination and emergence. Augsburg had indeed been the capital of the Late Roman province Raetia secunda: In establishing the Bavarian duchy, the Merovingians had taken up and integrated existing structures from the crumbling Ostrogothic administration of the northern Alpine region, now (thereby) connected to the former Roman province of Noricum ripense (Noricum along the River Danube). Noricum ripense seems to not have been under direct control of the Ostrogoths, or was at least more openly accompanied by an East Roman influence at the time of Justinian. However, the territory of the former provinces had to have been functionally re-aligned from Augsburg.
The deciding factor, in this case, was the way in which existing structures could be incorporated into the newly created Bavarian duchy. The significance of these structures is, at best and in a rudimentary sense, discernible in the Notita dignitatum, featuring only the most important streets and bases. A much more composite picture has emerged, however, with the reconstruction of the frontier hinterland through the help of both the Tabula Peutingeriana and archaeological findings. In addition to dozens of forts (castella) and smaller fortresses (burgi), various structures of military significance, such as streets (viae), corresponding stations (mansiones), grain silos (horrea), fiscal wares, and even pagi have to be taken into consideration. Many of these resources and infrastructural aspects did not disappear with the fall of the Western Roman Empire; rather, they persisted under Ostrogothic rule and beyond. For each coming political power, seeking to rule these lands in the centuries to follow, the absorption, adoption, as well as the regeneration of existing Roman structures, where was wise and possible to do so, was of fundamental significance. The Late Roman defense strategy was in no way restricted to the protection of the line of the Danube; rather, implied was the structuring und control of mobility and communication in the entire Alpine Foreland and beyond. The Frankish rulers also took care to bring trade and travel under their control – not without the Alps in mind. Moreover, although the Life of Severinus of Noricum seems to suggest that, at the end of the 5th century, the Roman administration had completely pulled out from the area, population structures in the region continued to persist: They appear in sources from the following centuries as Romani exercitales and tributarii with a notable military connotation. This is particularly relevant for the area surrounding Salzburg, for which solid documentation exists. However, other splinters of information can be found, which reasonably suggest the same for other regions. Evidently, the figures being addressed were military personnel particularly compelled to military service, receiving property or military assets in lieu of remuneration. The matter of continuity or the persistent survival of Roman elements seems to have been a largely local phenomenon, while various breaks in the continuum are to be expected, in light of certain “superstructures”. Thus in the case of Bavaria, it is important to consider which aspects of the Roman presence survived, how they were adapted to new, local conditions, and why Roman traditions more or less disappeared elsewhere. Reflecting on such questions allows us to provide the context needed to make sense of the Lex Baiuvariorum’s provisions – for instance, when viae publicae appear in one singular location of the lex, without any additional background information.
2. The Lex Baiuvariorum: origins, compositions, sources
The political and administrative context surrounding the Bavarian duchy provides important background for understanding and interpreting the corresponding textual sources. Nevertheless, it is important to firstly emphasize how working with texts involves the treading of fundamentally different territory. It is quite likely that, during the establishment and first arrangement of the Bavarian duchy in the 6th century, the respective norms of the duchy were recorded. None of these norms has survived directly, however; only traces are to be found. The most important source of the administrative organization of the Bavarian duchy is the Lex Baiuvariorum, having emerged significantly later and containing one particular title with provisions for the various functions of the Bavarian dux. The lex is disputed among historians and legal historians alike, particularly as relates to the precise estimation of the date of its origination, composition, sources, and effects. In terms of date of origin, there are two competing theories fundamentally formulated by legal historians and largely accepted or modified by historians. Both theories had to cope with the fact that the manuscript tradition set in rather late; thus both take compilations from the Early Carolingian period (late 8th century) as their point of reference. The most thoroughly formulated theory comes from Konrad Beyerle, though newly strengthened by Peter Landau. From the particular uniformity of the textual records and from the political development of the Bavarian duchy during this time the theory concludes that the Lex Baiuvariorum could have emerged rather late, namely – with differing emphasis – between the late 720s and the 740s. In effect, the lex is linked to tensions within the Agilolfing ducal dynasty, residing in Regensburg at the time. In contrast, Heinrich Brunner’s hypothesis – later refined by Franz Beyerle and recently strengthened through important distinctions made by Hermann Nehlsen and Harald Siems – is at odds with Beyerle’s and Landau’s assumption of a cohesive redaction and emergence of a complete lex, suggesting that the extant codex was composed of different, older layers of text. Of particular importance among these textual layers is an alleged Merovingian ruler’s decree, recognizable for the singularity of its content and language. This decree can be traced to the legislative efforts of the Merovingian kings in the early 7th century, i.e. those efforts responsible for other legal codes, such as the Pactus or the Lex Alemannorum, as well as the Lex Ribuaria. This hypothesis is not too infrequently related to the long prologue of the Lex Baiuvariorum: The history of the Lex Baiuvariorum’s redaction is thus set to begin in the 6th century, spurred, above all, by the Frankish Kings Chlothar II (584-629) and Dagobert I (629-639). Crucial is Brunner’s argument that the alleged, lost Merovingian decree was not exclusively at Bavarian command but was the result of the intention to subordinate the dukes (duces) in various border regions of the Frankish kingdom strictly to the authority of the Merovingian kingship.
The idea that the Lex Baiuvariorum is to have contained layers of older text is more convincing than that of a later, cohesive redaction of the complete text. In fact, the structure of the Lex Baiuvariorum indicates a regulative, indeed, a systematizing and pointed endeavor. This in no way remedies all irregularities and discrepancies within the various sources from which the textual layers originate, however. The first title solely addresses matters that concern the church; this character, shared by the lex only with its close relative the Lex Alemannorum, attests to significant political objectives. Here, the Codex Justinianus (529/533), which discusses church matters in its first section, also comes to mind. In clear contrast to the church, title II of the Bavarian lex addresses the legal standing and responsibilities of the dux. A shorter third title is devoted to the distinguished, aristocratic families in Bavaria, their relationship to the Frankish king, and (the amount of) their wergild. The titles IV through XXII are composed first and foremost of long lists of forms of compensation and wergilds, familiar from other leges barbarorum. However, matters of marriage, theft, arson, and questions of procedure etc. are also mentioned.
For various reasons, I believe that the largest section of the lex, mainly the first two titles, though also even the third, reach back into the 7th century in terms of their content. Possible editorship at a later point should not be ruled out, however. The relatively uniform manuscript tradition of the Bavarian lex was established much later; no manuscripts from before the end of the 8th century survive. This suggests that – as with the Lex Ribuaria – a later redaction formed the basis of a significant portion of today’s record of surviving manuscripts. Yet this conclusion in no way precludes the possibility that older textual layers are reflected in the lex, the one-time formal independence of which is recognizable to this day.
There are two aspects that are most significant, as relates to the structure of the text and the sources of the Lex Baiuvariorum: Firstly, noticeable similarities between the Bavarian and the Alemannic legal codes (Pactus and Lex Alamannorum) are to be found, which further correspond to the structure and select provisions. Contrary to the previous assumption of the Bavarian lex’s borrowing from the Alemannic code, Harald Siems has recently traced these congruencies to a common model, used by the compilers of the Alemannic and Bavarian leges independently of one another. Secondly, influences of Visigothic law on the Bavarian lex are undeniable; examples of such are to be found, most notably, in the fragments we have recovered of the Codex Euricianus, one of the oldest compilations of Visigothic law. These traces of influence are difficult to explain, when placing the origins of the Lex Baiuvariorum in the 8th century, i.e. after the fall of the Visigothic kingdom in the year 711. Corresponding assumptions have, in turn, attributed the text’s compilation to the “private work” of a scholar. This scholar is said to have prepared the text within a Bavarian abbey according to his own ideals or, even, as Clausdieter Schott has argued, to have forged the text in the Abbey of Niederaltaich. Hypotheses such as these are not all that convincing, however. Besides, these theories overly simplify the procedure for the creation of legally-binding norms in undue fashion, replacing a long process, shaped by records of consultation and consent, with the fantasy of a singular, legally-trained erudite. The Codex Euricianus was recorded at the end of the 5th century in Gaul. That one could exploit the text 250 years after its creation, in the sense of a free-floating reception of the compilation in the Bavarian legal code, seems thoroughly less plausible than the presumption of legal influences at the time, when Southern Gaul and Bavaria were equally a part of the Merovingian kingdom – an arrangement, which could have been the case only before the 8th century. Our ability to trace both the Bavarian and Alemannic lex back to the same model, even though the two were created and formed independently, corresponds well to the fact that both leges owe much to early 7th century efforts to create a lex for both duchies – indeed, the case for the Bavarian and Alemannic. In a similar sense, the obvious neglect of Visigothic legislation by the Kings Chindasvinth (642-653) and Reccesvinth (649-672) from the middle of the 7th century points in a similar direction. Whether or not this was also the case for the Lombard Edictus Rothari of 643 remains to be seen (upon further investigation).
3. Military Law in the Duke’s Statute of the Lex Baiuvariorum
With a focus on military law, the second title is of primary interest. This title was used previously by Heinrich Brunner in arguing that, behind pieces of the Lex Baiuvariorum, a Merovingian royal decree of general application that did not survive is to be reckoned with. An indication that Brunner did not pull his conclusion out of thin air appears in the heading of the second title, in fact; in strange grammatical form, the title claims to be: “About the dukes and their affairs, which pertain to them” (De ducibus et eius causis qui ad eum pertinent). This certainly sounds odd. Naturally, there was only one dux in Bavaria, so there would have been no reason to speak of duces in the plural, unless we assume that this passage was meant originally for more than one ducatus or duchy and, without further adaption, was simply incorporated into the Bavarian lex. Brunner was able to include further such examples. The more of a general decree we uncover in the text – the provisions of which extending far beyond Bavaria – the more interesting and significant the question becomes as to the role of Roman military law in the organizational arrangement of the Frankish duchies.
Here, the Merovingian kings arranged the legal protection of the Bavarian dux¸ whom they – and in part the people – had appointed and who was subordinate to them in rank: The title contains a comprehensive codex of military penal law, which was to have determined the conduct of soldiers both fundamentally and at times of war. The text addresses, among other things, sedition against the duke (seditio), inciting discord (scandalum) within the army or within the duke’s court, pillage and arson during military campaigns in the province (praedatio), and the theft of military equipment. In addition, regulations for the protection and special peace of the ducal court (curtis ducis), fines in the case of contempt of the ducal ban, dates for army and court assemblies (placita), as well as fines for failed appearances to such assemblies, were established. The text moves on to different provisions for dealing with matters of jurisdiction through the comes and the remaining iudices. A special position is occupied by the express provision regarding the case of revolt against the duke, as stirred by his own son. This appears to be the result of a concrete case, although it appears in the Lex Alamannorum, and is thus likely traceable to a common textual model.
The following cannot provide a comprehensive or even an exhaustive analysis of the duke’s statute – a text deserving of its own thorough and detailed commentary. Instead, a few provisions will be examined more closely. The first provisions of the duke’s statute of the Lex Baiuvariorum are worded in general terms and fundamentally concerned with the protection of the dux:
If anyone attempts to take the life of the duke whom the king appoints to that province or whom the people themselves choose as duke, and he is convicted so that he cannot deny it, let that man and his life be in the power of the duke, and let his property be confiscated by the state. And this is not to occur as an incidental provocation, but let the proven fact reveal the truth. And let it not be proven with one witness, but with three witnesses, all of equal class. If, however, one witness testifies and another denies it, then let them resort to the judgment of God, and let them go to the field, and let God give victory to whomever is to be believed. And let this take place in the presence of the people, so no one may die through malice.
Let no free Bavarian lose his freehold land or his life [unless punishable for] a capital offense; that is, attempting to take the life of the duke, inviting enemies into the province, or devising to seize the state (civitas) through foreign intervention. And [if] he is convicted, then let his life be in the power of the duke, and let all his property [descend] into the treasury (patrimonium). Moreover, for other offenses (peccata) that he commits, let him compensate according to the law (lex), as long as he has property. If, however, he has no property, let him be pressed into slavery, and let him serve that one whom he injured several months and years, if he was able to profit [from his act], until he restores the whole debt.
If anyone kills his duke, let his life (anima) be taken for the homicide he caused, and let his property be permanently confiscated by the state.
In the Lex Baiuvariorum the legal status of the Bavarian dux, according to the example of the Merovingian kingdom, was defined as a form of royal stewardship. The dux clearly remained subordinate to the king, though governing with power to the greatest extent that his domain allowed. The provisions quoted above, which demonstrate the tight, matter-of-fact, linguistic parallels between the text and similar regulations in the Lex Alamannorum for the protection of the Alemannic duke, joined concrete sanctions to seemingly necessary, fundamental clarifications and legal justifications. One example of such are the dictates given for trial procedures, in which evidence of traitorous activities was required to be presented to the dux. On the other hand, it was emphasized that the death penalty and the confiscation of property were only permissible in such cases of crimina capitalia. For all other offenses, the usual compensation system was to be employed, in which fines were paid first and foremost to the opposing party. In terms of criminal capitalia, the infliction of death penalties and expropriation needed to be especially justified, as there were no traditions of a binding nature to speak of.
The lex qualified various offenses against the dux as crimina capitalia, thereby assigning the form of punishment to the ‘public’ legal sphere. The quoted provisions for the protection of the Bavarian dux demonstrate a particular blend of highly complex legal concepts and simple forms of procedure. The very fact that punishment of treasonous acts was “not to occur within a window of opportunity but that the deed was itself to reveal the truth” (et hoc non sit per occasionem factum, sed probate res pateat veritatem) indicates close literal agreement with the Digest-title that contains the commentary of the Roman legal practitioner, Modestin, to the Lex Iulia Maiestasis, as the Lex Baiuvariorum’s editor, Ernst von Schwind, has already indicated. This title had dictated the inclusion of the defamed, of slaves, and of freemen as plaintiffs, even soldiers. Soldiers were usually excluded from the right of accusation, now included with the reasoning: “he who protects the peace must all the more be allowed the power to accuse”. The references to the Roman crime of lèse majesté (laesa maiestas) continue. Interesting to note is that the regulations addressing attacks on the life or person of the Bavarian dux had declared the planning of the crime already as punishable to the highest degree; the provision that was so central for the stability of the political order thus emanated from an entirely “unarchaic” understanding of the law. The criminal liability emphasized in the Lex Baiuvariorum, not only in the criminal attempt but also in the planning of the act, is quite evocative of the Lex ‘Quisquis’ from 397, which had decreed exactly the same for crimes of laesa maiestas. Even the punishment of the offense and the similar way in which treason was handled, namely through the double-sanction of the death penalty and confiscation of property, appears to be directly related to Roman laesa maiestas. Harald Siems recently considered it plausible that the Bavarian lex’s compilers – or the model thereby employed – could have called upon the legal collection of the crimen laesae maiestatis. This proposition seems much more likely than Theodor Mommsen’s theory about a letter from Gregory the Great. The former cannot be substantiated, however.
One aspect that might prove interesting is the location of the Roman crimen laesae maiestatis at or near the interface of public law and military law, as previously suggested by Mommsen in another context. For this reason, not only attacks on the Kaiser’s person are included but also numerous offenses related to military law, such as the failure to follow orders, mutiny, desertion (or absent without leave, i.e. AWOL) and treason, respectively. A transference of Roman treason to the Early Medieval regna, and to the respective duchies at that, is certain, though it is definitely possible that regulations pertaining to military law were also at play. This theory finds even more support, when the context surrounding the provisions of the Lex Baiuvariorum is considered. This includes their intended regulatory scope. The quoted regulation regarding the death penalty and its provisions for a pardon – or an arbitrary form of punishment – also evoke Late Roman military law: The perpetrator and his life should be within the control of the dux (in ducis sit potestate homo ille et vita illius), in other words, in the control of the highest ranking officer. The ability to make a decision, here, was not placed in the hands of the Frankish king but was to remain at the level of the ducatus. The duke’s authority to either have the offender executed or to pardon him is hardly a product of Christian influence. There is an arbitrary element here, as well, which proves more difficult to trace back to the laesa maiestas than to military law; the punitive authority of a high officer needed to be capable of a naturally flexible application, so that he could potentially pardon an offender, if circumstances made this advisable.
An additional aspect or quality that exemplifies the necessary influence of other legal-procedural principles under military pretext is the described evidentiary proceeding. This procedural demand is to have kept the significant danger of potential abuse small, while achieving a characteristic balance between differing procedural concepts. The quoted provision of the Lex Baiuvariorum indicates, in its relation to the Digest provision also quoted above, that the dangerous possibility of arbitrary justice triumphing over truth, in cases of treason against the duke, was taken as a given. The trial, which was contrived in opposition to this tendency, seems to have been determined by the legal practice of the military sphere: Could the three required witnesses for proof of treasonous activities not be provided, proof was to be organized through public ordeal by battle between witnesses and defendant. This was seen as a practical and acceptable form of proof in a case of life and law, which clearly did not always permit more complex methods of truth-finding. While the definition of punishable offenses outlined in the provisions pertaining to military law in the Bavarian and Alemannic leges indeed rested upon respective regulations of Roman treason, the (same) legal codifications presented its (procedural) provisions in a form modified/adapted to the changing realities of the Frankish kingdom.
From those offenses classified as treasonous within the text of the Lex Baiuvariorum emerged a much stronger punitive power as was customary in the case of homicide. Additionally, treason of country (proditio patriae) belonged to those grave offenses, the perpetration of which was anticipated within the army’s domain. These regulations are to be found in Late Roman military law, as well. According to the Strategikon of Maurice, “he who has been entrusted with guarding a city or fortress and who thereupon is to have surrendered or abandoned his post, against the order of his commander, receives the death penalty”. The above quoted provision in the Lex Baiuvariorum (the first provisions of the duke’s statute) thus considered it crimen capitale to summon enemies into the territory or to plot the taking of a city (civitas) by outside forces. In the related Lex Alamannorum, death or the “banishment to wherever the duke so chooses”, as well as the confiscation of property, was the possible penalty for the homo to have brought foreign plunder and arson upon the land. Here, both penalties of the crimen publicum tradition meet again, while the mitigation of the death penalty by way of banishment undeniably demonstrates, once again, an element of the arbitrary.
An additional tradition from the Roman army is continued in the separation between treasonous and non-treasonous offenses. Desertion and defection to the enemy were always treated as a break from the oath of allegiance in Roman times, while a guard’s negligence and lesser violations were punished as disciplinary offenses. However, another distinction was made, which bore repercussions for the sanctions of choice, namely those offenses committed in wartime – i.e. during a military campaign – and in peacetime. The Lex Baiuvariorum handled sedition (seditio, also scandalum in provincia, old-Bavarian carmulum) against the duke separately from inciting discord in the duke’s army (scandalum in hoste), thereby resorting to a distinction made previously in Roman law. Both offenses had likely been included in the Late Antique prohibition of coniuratio, which was, at the same time, perpetrated as a political offense and within the military domain. In both cases, instigators (seen as higher-ranking, in this case) were to be punished with a fine of 600 solidi, according to the Bavarian lex, whereas co-perpetrators of seditio were to pay 200 shillings, and free ‘followers’ or accomplices of a lower class (minor populus) were to pay 40 shillings.
In contrast, in the case of insurrection in the duke’s army, it was explicitly determined that, in addition to determining financial penalties, king and duke should have the right to impose penalties at their own discretion:
If anyone in the army that the king or the duke appoints in the province stirs up a quarrel (scandalum) within his own band, and men are killed there, let him compensate with 600 solidi to the state (in publico). And whoever causes beatings (percussiones) or injuries (plagae) or commits homicide (homicidium) there, let him compensate each according to his class (secundum suam genealogiam), just as the law (lex) requires. And let a man who does this extol the king or his duke as merciful as he grants him his life. Concerning lesser men (minores homines), however, if they stir up a quarrel (scandalum) in the army, let it be in the power (potestas) of the duke [to decide] which punishment (poena) they are to endure. For this practice must be eradicated, so that it does not occur. A quarrel frequently rises, in fact, over horse fodder or firewood, since some [soldiers] are assigned to defend farm buildings and barns, where hay and grain are found. This [disagreement] is forbidden so that a quarrel (scandalum) does not occur. If anyone finds fodder (pabulum) or firewood (ligna), let him take what he wishes, and let no one be prevented from taking [what he wants], so that a quarrel (scandalum) may not occur because of this. If anyone dares to do this and opposes this in some way that the law forbids, then let him, if he is discovered, be liable to military law in the presence of the duke (coram duci) or before his count (ante comiti suo); that is, let him receive fifty lashes (percussiones).
This provision addressed the weight and consequences of insurrection within the army. If fatalities were to result, the offender was to pay wergild, in addition to a high public fine, to the surviving family members, while the decision over the offender’s life or death was to rest in the power of the duke or king. Again, this arbitrary penal authority is met by the highest general. At the same time, the power of the Bavarian duke was explicitly connected to that of the king. This demonstrates that it was ultimately royal law, which was meant to place legal relationships in the Bavarian duchy mutatis mutandis upon a binding foundation. In its reference to the genealogiae addressed in the third title of the lex, it becomes clear that both titles must be seen in relation to one another.
The second section of the provision applied to discord incited by minores homines and fell entirely within the jurisdiction of the dux, or within the jurisdiction of his subordinate comes, respectively. In this case, the imposition of the type of punishment was left to the latter (the comes). In morally-didactic language, it was impressed upon that, in the search for horse feed and firewood, conflicts of a severe nature were not to develop: ille usus eradicandus est, ut non fiat. There is explicit mention of a military punishment (disciplina hostilis), consisting of 50 blows, to be imposed by the duke or, alternatively, the count under whose command the crime has occurred. The regulations quoted above explicitly indicate a special military penal law, which is reminiscent of the Roman disciplina militaris both conceptually and in the threat of corporal punishment (beatings, even possibly whippings) equally found in Roman military law.
Another offense within military law, which is referenced by the Lex Baiuvariorum, is “home invasion” (heriraita), precisely differentiated from “trespassing” (heimzucht). Both offenses reference armed attacks on homesteads (curtes) with the intention to surround a freeman with shields, arrows, and other projectiles. The difference, here, is the number of participants in the attack: heriraita only comes into question when 42 shields (i.e. men) are present at the attack; for those attacks with fewer shields than 42, heimzucht was said to have occurred. In contrast stands the particular sanction for this offense: While the primary perpetrators in the case of heimzucht were met with a fine of 12 solidi, the particularly public nature of heriraita becomes clear in the exact form of compensation; for the higher fine of 40 shillings was not to be paid only to the aggrieved side but to the duke, as well. Heriraita occurred with an armed band (hostili manu, collecta manu, manu armata, exercitus); the most closely related term in Latin for such troops was collectae. The term collecto contubernio, used in the same context in the Lex Salica, as well as in the clearly elevated penalty for homicides committed by such troops in the Lex Salica and the Lex Ribuaria, indeed demonstrate that regular military units are at play and were, indeed, deployed in such tasks. Those collectae practiced, in addition to their military tasks, a form of feud-like justice, which the Frankish kings struggled to combat as the punishable act of harizuht. Shortly after the year 800, Charlemagne expressly subsumed the omission of any kind of harizuht under the loyalty owed to the emperor: Its disregard has subsequently been counted among the eight cases to which the royal ban applied – together with arson, bride kidnapping, and other offenses – that were anchored in various leges.
The context of disciplina militaris becomes even more apparent in the following provision for violent plunder and arson on the part of the army, when committed without the explicit order of the duke:
If anyone in the army wishes through hostility to plunder the province without his duke’s order, or to take hay or grain or burn buildings, we forbid this totally, and it is not to occur. And hereafter let a count be careful [of its happening] in his retinue; in fact, let him give order (ordinatio) to his hundred-men and ten-men, and let each one watch over the troops that he commands so they do not act contrary to law (contra legem). And if anyone does this audaciously, it [the act] is to be examined by the count whose man does it (cuius homo hoc fecit). And if the count neglects to enquire who does this, let him restore all things from his own property; nevertheless, let him have time to investigate. And if such a powerful man does this that a count cannot restrain him (destringere non potest), then let him tell his duke, and let the duke restrain him according to law (distringat secundum legem). If he is a freeman, let him owe forty solidi, and let him restore all things with equal value. If a slave does this, however, let him be sentenced to capital punishment. Let his master, however, restore all things equal, since he did not forbid his slave to do such things. If you devour one another, you will perish quickly. Nevertheless, let a count not neglect to watch over his army, so that it does not act contrary to law (contra legem) within his province.
This problem is already addressed in the earliest decree of King Clovis, issued in the year 507 before the campaign against the Visigoths. Gregory of Tours later described the pillaging committed under the army of King Gunthram in vivid Old Testament imagery. The Lex Baiuvariorum also utilized drastic wording in reference to combating evil: “If you devour one another, you will perish quickly”.
The Bavarian text, in its efforts to combat this form of pillaging, reveals the entire military hierarchy – originating in and using the terminology of the Late Roman period – from dux down to comes, from centenarius to decanus on duty, each of whom was to supervise “his own” (sui), i.e. those homines subordinate to his command, and to apply his powers of coercion, if called for. In the particular verb of choice, distringere, a term with roots in military penal law is again utilized. In Frankish times, this verb was aptly communicated as districtio and often combined with the word bannus.
Here, the comes became quite significant: For it was the comes who was responsible for the respective order (ordinatio); he was to investigate (inquirere) possible offenses and determine the identity of the captured offender (cuius homo sit). The ancient tradition included the idea that the comes was to answer with his own property, if this investigative duty were neglected. In such a case, or in the case of all too powerful individuals among the offenders, the dux was to intervene and exact force (distringere) against the offender, forcing compliance. Free offenders were to be punished with a fine of 40 shillings and required to pay compensation for any damages; slave offenders – who must have been many in number in the Bavarian army – were punished by death, with their lord/master held responsible for those damages incurred.
Yet, there are terminological differences compared to Roman military law; soldiers were no longer referred to as milites, rather simply as homines. We cannot rule out the de-professionalization that is suggested by this terminological shift, though seemingly more important is the question the term itself reflects – one particularly relevant in a duchy – of general compulsory military service. The more open term homines (“men”) could also include slaves. Moreover, the term homo was more politically-charged, as the text of the general oath of allegiance has demonstrated. For free adult men – focused if nothing else on future military service – were to promise the Frankish king “allegiance like that of leudes” (fidelitas et leudesamio) or to be loyal (fidelis) to him “as a man should, by law, be to his master” (sicut homo suo domino per drictum esse debet). That is precisely what seems to be echoed by the concept of this Bavarian provision, even though loyalty in and of itself does not play a central role.
Precisely the extensive lack of an allegiance or loyalty category in the Bavarian lex is striking. The Lex Baiuvariorum documents a legal situation in which the subordination of dukes to the king is taken as a given, thereby emphasizing the duces’ allegiance to the king. Yet the population of the Bavarian duchy was in all likelihood not obligated to pay this allegiance to the dux, allegiant solely to his military command, instead. This is an argumentum e silentio, by necessity. It remains note-worthy, however, that those examples included from the Bavarian and Alemannic leges do not deem attacks on the life of the duke infidelitas. This can likely be attributed to the fact that the free population in this region, at the time of the leges’ recording, was required to pay allegiance not to the dukes but to the Frankish kings. This finding is important, in so far as the Frankish rulers had absorbed fundamental elements of Roman laesae maiestatis, – particularly with regards to infidelity offenses – placing these upon the legal foundation of the general oath of allegiance. The oath of allegiance was also that, which enabled the Merovingian and Carolingian kings to delegate those legal powers (provided them) to the relevant office, according to the appropriate military rank: Such was done through the instrument of the ban. Under these conditions, it became possible to connect crimen laesae maiestatis to the power of military functionaries like the duces. Indeed, treason was not only related to attacks on the person of the ruler but was inclusive of different military offenses, as well as protective of the highest officials. Here, the extent to which the adoption of crimen laesae maiestatis could be closely connected with infidelity offenses is once again demonstrated. This indicates, further, how regulations in the Bavarian duke’s statute – as these legal concepts were first received in the context of kingship – were successfully incorporated into the administrative routine of a border province.
4. From Roman Military Law to the Duke’s Statute of the Lex Baiuvariorum
In an investigation of the adoption and appropriation of Late Roman military law in Early Medieval Bavaria a clear distinction is made between the historical context of the Bavarian duchy’s establishment and the reflection of such elements in the text. This is due not only to the uncertainty of historical dating of the Lex Baiuvariorum but also to the method with which general historical findings are, from the outset, not intermixed with textual observations. Nevertheless, the aim is to illustrate a regional context within which the provisions of the Bavarian lex make sense. This ‘sense’ happens to be largely a product of Frankish interests in Bavaria.
Regarding the origins of the Bavarian duchy, as more recent research has identified a clear borrowing from precursory provincial-Roman structures, a regionally different integration of provincial-Roman elements into the Bavarian duchy seems plausible. Fortresses, streets, fiscal goods etc. could be integrated by the post-Roman rulers and their military elites into the new functional entity of the Bavarian duchy. As a result, we encounter the highly conditional Roman concept of via publica in the Lex Baiuvariorum. Munera publica, such as paraveredus, angariae etc., are to be included, even though they were known as servitia publica in the Early Middle Ages and despite the fact that the services owed by particular groups were increasingly transferred to ecclesiastical institutions, as indicated in the statute on coloni of the Lex Baiuvariorum.
However, such a regional-historical perspective can only provide the background needed to call attention to the complexity and selective nature of the problems addressed in these legal codes; for there is no doubt that the Lex Baiuvariorum was intended for Bavaria. Yet it cannot be assumed with equal certainty that the Lex was written in Bavaria by a Bavarian. Early Medieval Baiuvaria was a border region of the expanded Frankish kingdom; and it was in the scope of this kingdom that adoption and appropriation processes of legal systems occurred – traces of which are tangible in the text of the Bavarian lex. The result, one could conclude, is a compilation of various legal influences, fused into a composite whole through the directing hands of its compilers. Homogenization – to the extent that the text’s various stages would become indistinguishable – did not occur, however.
The quoted provisions from the duke’s statue reveal the “inconsistent” flexibility that is characteristic of the legal practice of the military, subordinated to the purpose of maintaining military discipline and the army’s readiness for deployment. It is precisely these many arbitrary elements, which demonstrate the attempt to reconcile legal considerations with practical needs. On the other hand, the stark separation between treasonous offenses and those other offenses penalized by fines, as well the distinction between offenses committed in wartime and those committed in peacetime, demonstrates the importance of defining crucial issues as precisely as possible in a frontier duchy. In this light, the Lex Baiuvariorum proves to be a powerful text, illustrative of the exceptional character of the frontier duchies and their particular legal order, in contrast to the other leges of the Frankish kingdom.
Different to other particular sections of the Lex Baiuvariorum, it is not readily possible to name a definite written source for those elements evidently pertaining to military law in the duke’s statute. A form of umbrella law for all Frankish duchies, as Brunner’s theory of the lost Merovingian royal decree suggests, would indeed not be without Late Roman forerunners. However, equivalent regulations by the Eastern Roman Emperors Anastasius I (491-518) and Justinian I (527-565) must undoubtedly be ruled out as the direct model for the Merovingian royal law. Yet from where did the Frankish kings take their regulations of military law; from which texts could such a royal decree have been composed? In light of the remaining textual borrowings, though also due to parallels with the Lex Alamannorum, it can be assumed that it is not a matter of oral customary law but one of the adoption of legal texts. The military context of the duchy and the provisions contained within the Lex Baiuvariorum suggest perhaps less of a legal compilation on the Roman crimen laesae maiestatis than a dossier of texts pertaining to military law. Such texts, it may be suggested, were used by the Frankish kings as a framework for their Eastern duchies. This framework was then fleshed out individually in the specific duchies and, in part, translated into vernacular terms. Naturally, this is impossible to prove with any certainty. If one takes the spectrum of the remaining traceable sources in the Bavarian lex into account, it does not seem by any means implausible, though still unlikely, that the Merovingian monarchs directly called upon collections of Roman statutes of military law. Such collections are indeed well-attested and were in wide circulation, as the Strategikon of Maurice has shown in reflecting older traditions of Latin military law. However, it is ultimately the numerous imprints of Visigothic law in the Lex Baiuvariorum, which make the Franks’ borrowing from a Visigothic text originating in Gaul (or, alternatively, from an intermediate text drawing on such a text) seem possible. Karl Zeumer had suggested that the provisions for treason in the Lex Baiuvariorum, as well as similar regulations in the Lombard Edictus Rothari, might be traceable to a common Visigothic model. These provisions would thus have been drawn ‘from the old law of the Visigoths’, which had only existed under King Reccesvinth in the 7th century. The little that remains today of the extensive Codex Euricianus hardly allows for any conclusions to be made as to the Visigothic military law at the time. This is the case, even when recorded provisions about the patrocinium and the Bucellarii allow us to suppose that, originally, the Codex Euricianus would have contained much more, regarding questions of military law, than indicated by the few remaining fragments we have today. Meticulously comparing the Lex Baiuvariorum with its Visigothic sources and parallels, Isabella Fastrich-Sutty learned and shared much about the methods of its compilers. Yet for the duke’s statute of the Bavarian lex, specifically, she was hardly able to identify parallels to Visigothic law. However, the number of parallels to be possibly taken into account in this domain may be larger than initially assumed.
Perhaps the method of strict textual comparison reaches its limits in the case of military law. Precisely the flexibility of military law in imposing sanctions, in particular, may have advised its composers (of the Lex Baiuvariorum) against an all too rigid transfer of sanctions from a possible model to the equivalent offenses in the Lex Baiuvariorum. Important to the adoption and afterlife of Roman military law in the Lex Baiuvariorum was the reservation of the death penalty and confiscation for particularly severe offenses. Of particular interest to the modern observer is the variable handling of most sanctions that occurred. With this context in mind, a certain ability to work independent from existing models appears among the compilers, in that particular punishments attested in Visigothic law were now provided for offenses that had actually called for different sanctions in Visigothic law.
It can be assumed that the alleged Merovingian royal decree, which had guided the conception of the Frankish duchies, had already encroached upon those Visigothic legal texts upon which it was based. For we must assume that the provisions for laesea maiestatis – originally intended for the Roman emperor, then applied to the successor kings – must have been eventually applied to the person of the dux. This was done, in order to link such provisions to regulations regarding army discipline in wartime and peacetime, as well as to clarify questions of jurisdiction and legal procedure. This is even more likely, given that the office of the dux played a distinctly more important role in the Frankish context than in the Visigothic kingdom, where office and title appear in legal texts not before the 7th century. The appeal of Brunner’s concept of a Merovingian “royal decree” as a decreed framework for the Frankish duchies lies, if nothing else, in that it explains why such different regulations affecting the office of each and every dux – which had until that point been passed on within various textual contexts – were then compiled into one consistent statute, intended especially for the conditions present in a frontier duchy.
The incorporation of such models in the text of the Lex Baiuvariorum will have provided another reason to adapt particular items to present-day conditions, as concerns the sanctions to be imposed. In the process, further far-reaching changes came to be – for example, the ecclesiastical transformation of and changed reasoning on numerous provisions: He who kills the dux, it so reads, should pay for the soul of the dux with his own, and his property should be permanently confiscated. The curious word choice anima pro anima and in sempiternum immediately suggests that a cleric must have been involved in the formulation of this passage; there are many other passages in the lex that carry the mark of the ecclesiastical hand, downright employing Mosaic rhetoric. These passages ‘give away’ not only that clerical/ecclesiastical scholars had some part to play: such passages also document far-reaching processes of the transformation of legal thought itself. The translation of key legal terms and their related concepts into the vernacular represents another momentous intervention in the law.
In light of these many possible processes of the production, compilation, and redaction of legal texts, if one were to take stock of the long journey Late Roman military law has traveled since its initial adoption in Gaul, to its taking root in Early Medieval Bavaria, one would, at best, maintain an indirect influence of Late Roman texts. Ruth Leys setzt sich in ihrem Beitrag mit einem Trend oder besser einem Wiedergänger in der Entwicklung der internationalen Emotionsforschung auseinander, der Somatisierung und Individuierung der Gefühle vor dem Hintergrund essentialisierender Identitätsdiskurses. Im Zentrum steht die kritische Einordnung der Arbeit der französischen Philosophin Catherine Malabou: The New Wounded: From Neurosis to Brain Damage, von 2007.
An den Ausgangspunkt ihrer Argumentation stellt Leys ihre gleichfalls 2007 publizierte Arbeit „From Guilt to Shame: Auschwitz and After“, in der es um die Rezeption des Unbehagens mit dem psychoanalytisch gefassten Begriff „survivor syndromes“ geht. Das wurde seit den 1960er Jahren lange unangefochten als Schuldgefühl interpretiert, das aus einer unbewussten Identifikation mit den Angreifer entstehe. Wie Leys schreibt, ginge diese Lesart für viele von einer impliziten Konspiration oder Komplizenschaft von Opfer und Aggressor aus, die jedoch für die Erklärung der sozialen Kohäsion der Opfer, ihres Füreinandersorgens und ihres Widerstandes nicht tauge. Die daraus resultierende Ablehnung der psychoanalytischen Interpretation finde sich auch im neueren Traumadiskurs, wie Leys am DSM zwischen 1980 und 1987 deutlich macht, in dem die „Überlebensschuld“ vom Schlüsselsymptom durch den Affekt der Scham ersetzt, zum Begleitsymptom herabgestuft wurde. Es folgte der Aufstieg des Scham- gegenüber des Schuld-Begriffs in medical sciences and humanities, wobei die Intentionalität der Schuld in die nicht-intentionelle Scham transformiert, positivistisch essentialisiert worden sei. (S.3). Während Schuld also eine intentionale Handlung charakterisiere, kennzeichne Scham als Affekt eine Person, die von Tomkins and Elkman [Who?] als entwicklungsgeschichtlich entstandene jüngere Affekte, gegenüber den älteren wie Freude, Ärger und Angst, eingekörpert wurden. Affekte begreifen diese Autoren als kulturenübergreifende angeborene Gefühlsqualitäten. Sie seien evolutiv entstanden und riefen durch bestimmte Auslöser, Verhaltensweisen hervor, die unabhängig vom Denken - also von Intentionen - funktionierten. Dass Ruth Leys in ihrem paper wie bereits in ihrem Buch die Privilegierung der Scham gegenüber der Schuld an Giorgo Agamben’s Schriften festmacht, leuchtet mir ein. Dass sie es außerdem an den Arbeiten der Queer-Theoretikerin Eve Kosowsky-Sedgwick zu belegen versucht, überzeugt mich nicht, weil die Autorin seit ihrem Klassiker „The epistemiology of a closet“ nicht unter dem Verdacht der Essentialisierung queerer Identitäten steht. Darauf hat Vincent Keith in seiner Buchrezension im Journal Critisism bereits ausführlich und differenziert hingewiesen.
Leys argumentiert weiter, dass der Aufstieg der „neuen Scham“ die Auseinandersetzungen um Absicht und Bedeutung auf der Ebene Identität und Erfahrung in harmonisierender Weise verlagere (S.4), verschiedene Menschen (Identitäten) hätten nunmehr einfach nur unterschiedliche Erfahrungen. Der Konflikt über die Bedeutung von Unterschieden im Handeln und Glauben werde so in die Logik der Diversität von emotionalen Identitäten transformiert.
Seit dieser Bestandaufnahme von 2007, die eine breite Diskussion unter anderem in Critical Inquiry (2011/2012) nach sich zog, habe sich, so Leys, die Umwertung des Traumas weiterentwickelt und eine neue Dimension erreicht, die sie anhand der Arbeit von Catherine Malabou’s „new wounded“ exemplarisch aufzeigen möchte. Im Gestus der Verwerfung psychoanalytischer Traumadeutungen werden von Malabau neurologische und hirnanatomische Ansätze der Schmerz- und Gewaltforschung inthronisiert. Mit der „Hirnläsion“ als Schlüsselbegriff, erfolgt eine Parallelisierung von Trauma und Alzheimer-Erkrankung. Für beide wäre ein ge- bzw. zerstörtes „emotionales Hirnareal“ ursächlich, das die davon Betroffenen der Welt entrücke, affektiv abstumpfen lasse und damit ihres Selbst entfremde.
In ihrer Argumentation bezieht sich Malabou auf wenige Freud-kritische Analytiker wie Davoine und Gaudillière bzw. neurowissenschaftliche Quellen wie den Portugiesen António Damásio. Letzterer verglich 1994 die emotionale Entfremdung eines historischen Unfallopfers aus dem 19. Jh., Phineas Gage, mit den psychischen Veränderungen seines Tumorpatienten Elliot, deren gemeinsame Ursache er in der Zerstörung des „präfrontalen Cortex“ sah, woraus er seine Theorie des „somatischen Markers“ ableitete. Nach Damásio seien Entscheidungsfindungen das Ergebnis einer Zusammenarbeit unterschiedlicher Systeme emotionaler und kognitiver Hirnregionen, die durch Beschädigungen des „präfrontalen Cortex“ als Sitz des „emotionalen Hirns“ gestört werden könnten, wie beispielsweise bei Traumatisierungen. (S.9) Trotz zahlreicher profunder Kritiken an Damásio knüpfen Davoine und Gaudilliere und mit ihnen Malabou an dieser Hypothese an und stellen eine direkte Analogie zu Traumaopfern, auch solchen des II. Weltkriegs her.
In der Folge prüft Ruth Leys drei Argumente von Malabous Denkfigur der „New Wounded“ (S. 12):
- In ihre Kategorie des „New wounded“ subsumiert Malabou diverse wie distinkte Gruppen, nämlich unterschiedlichste organische Hirntraumen und -erkrankungen, sodann psychiatrische Krankheitsbilder von Alzheimer über Schizophrene bis hin zum Tourette-Syndrom und schließlich Personen mit PTSD (Posttraumatic Stress Disorder), einschließlich der Opfer des Houlocaust, Kriegs- oder durch Naturkatastrophen traumatisierte. Allen gemeinsam seien ähnliche Depersonalisierungs- oder Entfremdungseffekte.
- Die gemeinsame Ursache der „new wounded“ sei eine somatische Beeinträchtigung des vermeintlichen „emotional brains“, die Freud’schen psychoanalytischen Erklärungen nicht zugänglich wären. Indem sie Emotionen neurologisch und hormonell erklärt, können diese vor allem durch Störungen ihres Wirkungsortes verändert werden. Die semantische Bedeutung des Traumas sei daher für das Subjekt ebenso ohne Belang, wie die Intention des Traumatisierers (perpetrator’s). Damit erübrige sich der Sinn der Täter-Opfer-Unterscheidung, beide zählt Malabou zu den „new wounded“.
- Die emotionale und affektive Apathie sei das alle Traumen verbindende Element, das die Persönlichkeit sogar gegen das eigene Leiden unempfindlich mache, insofern „leide“ das „emotionale Hirn“ und nicht Person.
Als ich das Paper das erste Mal durchgelesen hatte, hat mich die ganze Malabou-story befremdet, warum sollte man Malabou überhaupt ernst nehmen? Dann fiel mir eine historische Parallele auf.
Um einen Anknüpfungspunkt zu schaffen, möchte ich diese aktuelle Debatte auch als Fortsetzung oder besser Neuverhandlung der Diskussion um die Oppenheimsche Traumatische Neurose in der Deutschen Psychiatrie vor fast exakt 100 Jahren verstehen. Bei deren Neuinterpretation trug gerade das Fehlen des Nachweises eines neurologischen Korrelats (im Sinne Wilhelm Griesingers) um 1912 zu ihrem Fall bei, an dem Max Nonne und Karl Bonhoeffer federführend beteiligt waren. In deren Lesart wurde aus der Traumatischen Neurose eine Begehrensneurose. Darin wurde die Frage schuldhaften Verursachung ebenfalls vom Trauma entkoppelt und auf eine andere Weise als hier in eine subjektive Intentionalität des Geschädigten, eine affektive individuelle Begehrensstruktur transformiert. Auch verstand Bonhoeffer den Affekt als „körpersprachlichen Ausdruck gefühlsgeladener Vorstellungsinhalte.“ Den Hintergrund dieses Wandels – der (wie in der aktuellen Diskussion) auch nicht frei von antisemitischen Ressentiments und zwar damals gegenüber Oppenheimer war – bildeten schließlich handfeste wirtschaftliche und staatliche Interessen, nämlich die Zurückweisung von Versicherungs- und Rentenansprüchen Traumatisierter, weshalb die Neu-Diagnose auch als Rentenneurose in die Psychiatriegeschichte einging.
Ruth Leys nennt im dritten Teil ihres papers drei Kontexte zur Einordnung der Diskussion um die „new wounded“, nämlich „commitment to anti-intentionalsm“, „commitment to materialism“, „commitment to the primacy of identity“. Mich würden jedoch vor dem Hintergrund des historischen Beispiels auch darüber hinausgehende Überlegungen zu den Intentionen und Auswirkungen der Verschiebung von der „Schuld zur Scham“ interessieren.
Zunächst möchte ich nach dem Echo auf Malabous „new wounded“ in den intellektuellen und wissenschaftlichen Communities über Slavov Zizek hinaus fragen. Wie reagieren die tangierten Disziplinen: Psychoanalyse, Psychologie und Psychiatrie und wie die angesprochenen drei Opfergruppen auf diesen steilen Thesen? Und gibt es auch allgemeinere gesellschaftspolitische Interessen und Tendenzen, die diesen neuerlichen Turn unterstützen?
Parallele Entwicklungen der Re-Subjektivierung und Essentialisierung lassen sich schließlich seit den 1990er Jahren auch in anderen Bereichen von Emotions- und Identitätsdiskursen ethnischer, sozialer und sexueller Differenz finden. Hier spielt der Bedeutungszuwachs der Biowissenschaften gegenüber den Humanties als Referenzrahmen ungelöster Fragen eine entscheidende Rolle. Vielleicht könnte auch eine breitere Kontextualisierung der Protagonistin und ihrer Stichwortgeber in den aktuellen politischen Strömungen weiterhelfen, die sie antreibenden Motive und vielleicht auch Ängste zu verstehen?

Ruth Leys critiques the trend or, even better, the return of the development of international research on emotions, while approaching the somatization and individualization of emotions against the backdrop of essentializing identity discourses. At the center of this undertaking is a key analysis of the 2007 work The New Wounded: From Neurosis to Brain Damage of the French Philosopher, Catherin Malabou. Leys begins her argument by examining her own work, From Guilt to Shame: Auschwitz and After, published in the same year of 2007, which addresses the development and usage of the psychoanalytical term “survivor syndrome”, formulated as a response to the discomfort and unease experienced by Auschwitz survivors. Since the 1960s, the interpretation that a sense of guilt was at the root of such discomfort at having survived at all, was held to be indisputable, this guilt somehow attributed to a subconscious identification with the perpetrators. As Leys writes, this particular interpretation rests on an implicit act of collusion or complicity by the victims with their aggressors – a notion, which does little for the provided explanation of the victims’ common social cohesion, collective care for one another, or shared political resistance. The resulting rejection of this psychoanalytical interpretation of “survivor syndrome”, in the end, can also be located in the new trauma discourse, as Leys demonstrates with the case of DSM from 1980 to 1987, in which the primary symptom of “survivor guilt” has been replaced by the affect of shame, thus relegated to the status of an accompanying symptom. Following this development, the act of privileging the term “shame” over “guilt” becomes positively essentialized in the medical sciences and humanities, where the intentionalism of guilt is transformed into the unintentionalism of shame. Whereas guilt is said to characterize an intentional action, so shame characterizes a person. Tomkin and Elkman understand shame to be an evolutionarily younger emotional quality, compared to earlier human affects, such as joy, fear, or anger – all, of which, supersede the boundaries of culture. They are said to come to the fore in the face of particular triggers or behaviors without conscious involvement of the mind. Striking to me is that Leys, in both her paper as well as in her book, concretizes the privileged position afforded to shame, as opposed to guilt, found in Giorgio Agamben’s writings. Her attempt to substantiate the works of queer-theorist Eve Kosowsky-Sedgwick, however, is less convincing, as the author herself has had little association to the topic of the essentialization and biologicalization of queer identities. In my view, Sedgewick’s reference to Tomkins does not attempt to ascribe the affect to a biological body and thus to absolve him of an intentionality; rather, she uses Tomkins to provide opportunities for the use of affect in theoretical and political contexts. Vincent Keith has already indicated this very problem in his detailed book review, published in the journal Criticism. Furthermore, Leys argues that privileging the “new shame” in fact relocates the conflict or tension surrounding intention and meaning to the level of identity and experience, doing so in a harmonizing fashion (page 4). According to this argument, different people (different identities) would simply have different and varied experiences, and the conflict surrounding the meaning of differences in action and belief would be transformed from that of emotional identity into a logic of diversity.
After this 2007 taking-of-stock, which led to, among other things, a wide discussion in Critical Inquiry (2011/2012), the revaluation of trauma was taken further, reaching a new dimension, which the author attempts to exemplify with the work of Catherine Malabou’s “new wounded”. In rejecting psychoanalytical interpretations of trauma, Malabou commissions neurological theories of research into the service of pain and violence. With the “brain injury” as her key term, she draws parallels between trauma and Alzheimer’s disease. For both disorders a destroyed and destructive “emotional brain region” would be the cause – as a result, the person is cut off from the world, affectively impassible, and estranged from the Self.
Malabou references few Freud-critical psychoanalysts, such as Davoine and Gaudillière, as well as failing to name some neurological sources, such as the Portuguese António Damásio. In 1994, the latter compared the emotional alienation of a historic accident victim from the 19th century, a man named Phineas Gage, with the physical changes of his tumor patient, Elliot. The common cause of the affective disturbance could be located in the damaged prefrontal cortex, from which he deduced his theory of “somatic markers”. According to Damásio, decision-making processes result from the combined efforts of different systems within the emotional and cognitive regions of the brain, which can be destroyed via damage to the “prefontal cortex” as the seat of the “emotional brain”, for example, in the case of trauma. Despite wide-spread, profound criticism of Damásio, Davoine, and Gaudillière, Malabou aligns herself with this hypothesis, creating a direct analogy to trauma victims, including those from World War II.
As a result, Ruth Leys puts three arguments of Malabou’s theory of the “new wounded” to the test (page 12):
- In her category of the “new wounded”, Malabou groups together both distinct and diverse categories, namely physical brain traumas and diseases, moving on to psychiatric diseases, from Alzheimer’s and Schizophrenia to Tourette’s syndrome and PTSD (Posttraumatic Stress Disorder). Finally, she includes the victims of the Holocaust, as well as victims of traumas related to war or natural catastrophe. These groups together are said to represent depersonalization or alienation effects.
- The common cause of the “new wounded” is said to be a somatic adverse effect of the “emotional brain”, which cannot be explained by Freudian psychoanalysis. By declaring emotions neurological and hormonal, they can, above all, be changed through the destruction of its site of origin. The semantic meaning of trauma is thus, for the subject, also without importance, similar to the intention of the traumatizer (the perpetrator). As a result, the significance assigned to the meaning of the perpetrator-victim-distinction is moot: Malabou includes both perpetrator and victim in the category of the “new wounded”.
- Emotional and affective apathy is said to be the singular element, which binds all traumata together, suggesting, further, that the person becomes desensitized to his/her own pain. This means that the “emotional brain” feels pain, rather than the person.
As I read this paper for the first time, the entire Malabou reference seemed a bit strange to me – why should Malabou even be taken seriously? Then a historical parallel occurred to me.
In order to create this linkage, I would like to try and understand this current debate as a continuation or even better a new approach to a discussion surrounding Oppenheim’s Traumatic Neurosis in German Psychiatry, exactly 100 years ago. In claiming a lack of neurological evidence, in the sense of Wilhelm Griesinger Max Nonne and Karl Bonhoeffer initiated a reinterpretation of Traumatic Neurosis. In their reading of the situation, it is instead more a matter of a neurosis of desire – a so-called Begehrensneurose. The question of guilt-ridden cause was also divorced from trauma and, in a form different from Malabou, transformed into a subjective intentionality of the damaged, an affective, individual structure of desire. Bonhoeffer also understood affect to be “a body-language expression of emotionalized imaginative content”. The context of this change – which, as in the current discussion, was also not free from anti-Semitic sentiments, given Oppenheimer’s background – ultimately created concrete, economic and national interests, i.e. the rejection of claims to insurance and compensation for the traumatized. For this reason, this new diagnosis entered the history of psychiatry as “compensation-neurosis”.
Ruth Leys names three contexts in the third section of her paper, on which one might orient the discussion of the “new wounded”, namely with a “commitment to anti-intentionalism”, “commitment to materialism”, and “commitment to the primacy of identity”. And yet, in the context of this historical example, further thoughts, as to the intentions and effects of the movement from “guilt to shame” would be of interest to me. Next, I would like to know how Malabou’s “new wounded” has been received in the intellectual and scientific communities, beyond the critique of Slavov Zizek. How have the disciplines of psychoanalysis, psychology, psychiatry, and neurology responded? And, further, how did the three groups of victims, addressed in this work, react to these bold points? And are there more general sociopolitical interests or trends, which might support this new turn? Since the 1990s, ethnic, social, and sexual variability can be located within the parallel developments of re-subjectification and essentialization in other areas of emotion and identity discourses. Here, the growth in significance of the biological sciences, as opposed to the humanities – as a reference point for unanswered questions – plays a crucial role. Would not a more inclusive contextualization of the protagonist and her primary reference within the current political debates be indeed helpful, in understanding her motives and even her fears?

Ausgangstext - Deutsch Wenn man bei einer Fahrt mit der S-Bahn, vom Bahnhof Warschauer Straße kommend, stadtauswärts in Richtung Ostkreuz auf der rechten Seite aus dem Fenster schaut, kann man den hohen, schlanken Turm der Zwingli-Kirche gar nicht übersehen. Von diesem Turm, in dessen Schatten ich die Jahre meiner Kindheit und Jugend verlebte, will ich nun zwei kleine Geschichten erzählen. Beide haben sich unmittelbar nach dem Ende des II. Weltkrieges zugetragen.
Die erste Geschichte ereignete sich an einem der ersten warmen Maitage des Jahres 1945, gleich nach der Beendigung des Krieges. Da stand mein Vater eines abends auf dem Balkon unserer Wohnung am Rudolfplatz. Sein Blick war nach Westen gerichtet, wo sich vor dem glutvollen Gelb-Rot der untergehenden Sonne die scharfen Konturen des schlanken Turmes der Zwinglikirche wie ein kunstvoller Schattenriss abzeichneten. Noch lag ein stickiger Brandgeruch über der Stadt mit seinen tausendfachen Ruinen. Die Zwinglikirche aber, in der seine beiden Kinder getauft wurden, hatte die Apokalypse weitestgehend überstanden. Mein Vater erfreute sich an dem malerisch schönen Anblick, der sich ihm an diesem Abend bot. Doch, was war das? Zutiefst erschrocken, in der Bemühung keiner Sinnestäuschung zu erliegen sich die Augen reibend, erblickte er im Strahlenlicht der gerade untergehenden Sonne feine Rauchschwaden, die aus der Spitze des Kirchturmes kräuselnd in die Lüfte stiegen. Erst fein und schwach, dann aber auch wieder dicht und drohend schwarz als stünde schon der ganze Turm in Flammen. Sollte nun, da das Grauen des Krieges der Kirche nicht habhaft werden konnte, sie zu guter Letzt nun doch noch das Schicksal der vielen anderen Gotteshäuser in unmittelbarer Nachbarschaft teilen?
Da galt es schnell zu handeln. Er bewaffnete sich mit 2 Eimern und rannte, so schnell er konnte, quer über den Platz zum Gemeindehaus, rief nach Pfarrer Winter und erklärte diesem so schnell und eindringlich wie möglich seine Beobachtung. Ein schnelles Eingreifen war gefordert. An ein in normalen Zeiten gängiges Verfahren, in solch einem Fall die Feuerwehr zu rufen, war natürlich nicht zu denken. Das mussten die beiden Herren nun schon selber erledigen. Auch Pfarrer Winter bewaffnete sich nun schnellstens mit zwei Eimern und eilte mit meinem Vater zunächst an die Pumpe an der Ecke Caprivistraße, um diese nun auch zu füllen. Die häusliche Wasserversorgung war ja in jenen Tagen total zusammengebrochen. Dann machten sich die beiden Männer mutig und pflichtbewusst auf den beschwerlichen Weg, fest entschlossen, dem Feuerteufel den Kampf anzusagen. Nur von einem Feuer war weit und breit nichts zu sehen, geschweige denn, dass die von unten wahrgenommenen Rauchschwaden auch nur einen Anschein von Brandgeruch hinterließen. Die Männer waren zunächst ziemlich ratlos. Beide hatten doch unabhängig voneinander die Rauchschwaden beobachtet! Erst als man vorsichtig die oberste Turmklappe öffnete und die ganze ominöse Sache auch von außen betrachtete, war des Rätsels Lösung schnell gefunden: kein Feuer wollte den Turm der Zwinglikirche zerstören. Ein unübersehbarer Mückenschwarm hatte sie genarrt. Millionen von sogenannten „Schwarm – Mücken“, die vor allem zu dieser Zeit der warmen Maiabende sich besonders an solchen Orten zum Zwecke der Paarung zusammenfinden, konnten von unten her gesehen tatsächlich wie Rauchschwaden erscheinen. Die beiden mutigen Männer waren sichtlich erleichtert und Pfarrer Winter schickte ein tief empfundenes Dankgebet gen Himmel.
Übersetzung - Englisch If you look out the window on the right-side of the S-Bahn, while riding from Warschauer Straße station away from the city, in the direction of Ostkreuz, it’s impossible not to catch a glimpse of the high, slender church tower of the Zwingli-Kirche. I’d like to tell two stories about this tower, having spent the years of my childhood and adolescence in its shadow. Both stories take place immediately after the end of the Second World War.
The first begins on one of the first warm days of May in the year 1945, right after the end of the war. One evening, my father was standing on the balcony of our apartment on Rudolfplatz. His gaze was directed to the west, where the sharp outline of the Zwingli-Kirche’s slender tower loomed on the burning, red-yellow horizon of the setting sun like an elaborate silhouette. A suffocating burnt smell still lingered above the city, with its countless piles of rubble. Yet the Zwingli-Kirche, the place where his two children had been baptized, had largely survived the apocalypse. My father took pleasure in the picturesque view that the evening had provided. Yet, what was that in the distance?
Shaken to the core, rubbing his eyes to confirm that it was not all just an illusion, he caught sight of light plumes of smoke in the light of the setting sun, rising in curls from the top of the church tower. First, thin and soft, then thick and an ominous black, as if the whole tower were in flames. Should the church finally share the same fate as the many other houses of worship, nearby – the horrors of war having failed to capture it the first time?
One had to act fast. He armed himself with two buckets and ran as fast as he could across the square to the parish hall, calling for Reverend Winter, explaining to him as quickly and as pertinently as possible what he had seen. They had to intervene, fast. Reverting to the standard procedure in such a situation – in this case, calling the fire department – was certainly not an option. Both men had to handle it themselves. Reverend Winter armed himself hastily with two buckets also, then, hurried with my father to the pump on the corner of Caprivistraße to fill them. The residential water supply was completely collapsed in those days. Both men then gathered their courage and sense of duty and went on their way, readying themselves for battle against the flames. But a fire was nowhere to be seen, not to mention that the spotted puffs of smoke were accompanied by only the pretense of the smell of smoke. The men were stumped. But both had witnessed rising smoke independently from one another! It was only when one had carefully opened the highest hatch to the tower and looked down at the ominous source that the riddle was solved: It was not fire that had tried to destroy the church; a swarm of mosquitoes, now readily apparent, had fooled them. Millions of so-called “swarm-mosquitoes”, who often gather to mate at places like this one, especially on warm evenings in May, had, in fact, appeared as plumes of smoke, when seen from below. Both brave men were visibly relieved, Reverend Winter sending a heartfelt prayer of thanks into the heavens/heavenward.

I am a social anthropologist by training with a focus on contemporary German cultures of immigration and integration, though I have also completed degrees in German history and linguistics, as well as international relations, allowing me to translate, with great expertise, difficult academic texts and presentations in the social sciences and the humanities. For more than two years I have worked as the in-house language expert for a Berlin-based historical research institute, prior to which I followed my love of language to English-teaching and copy-editing opportunities, often in the form of web-content management.
At heart, I am passionate about public access to history, global culture, and the arts. Through various professional experiences in museums, galleries, and event-planning organizations I have gained a wide range of skill in the translation and preparation of exhibit text and/or informational documentation for the general public.
Though I now call Berlin, Germany home, I am originally from the northwestern corner of the United States, where I first became well acquainted with the German language through a high-school exchange program. I have been a student of its ways ever since, recently completing a German-language degree in social anthropology this past fall.
I am eager to expand my translation repertoire and look forward to opportunities to do so.
