This phrase has cropped up in a writ. This part of the document is refuting the validity of a customs seizure and is quoting article 323 al. of the Code des douanes, as follows:
"Ceux qui constatent une infraction douanière ont le droit de saisir tous objets passibles de confiscation, de retenir les expéditions et tous autres documents relatifs aux objets saisis et de procéder à la retenue préventive des objets affectés à la sûreté des pénalités."
It's the " objets affectés à la sûreté des pénalités" bit which is causing me a headache. Are these objects that are subject to fines? I think it's more than that, though. The real problem is I'm finding it difficult to parse the sentence. Perhaps I've been looking at it for too long!
Any help would be most gratefully received.

these items will be used as collateral - returned to the owner when fines are paid, or if the imposed fines are not paid, they will be seized as would the collateral for a loan in case of default.

: Well found! But "affecté à la sûreté de" does not translate as "intended to ensure" (and, in the same doc, rétention is not really seizure, either) // I was just suggesting that the ref, although good, is not 100% reliable

One of the definitions of 'affecter' = 'destiner', so I don't quite understand your objection, and I never mentioned 'seizure'.

The word "assigned" is better place when it comes to securities because there is an element of coercion which is a idea behind Security Regulations

Retenue pour sûreté des pénalités
Rétention constituant une mesure conservatoire immédiate exercée en cas de constatation d'infraction douanière :
soit sur les moyens de transport et les marchandises litigieuses non passibles de confiscation, en cas d'infraction flagrante (article 378 CD), concomitamment ou postérieurement à la constatation d'infraction ;
soit sur les objets affectés à la sûreté des pénalités (article 323 CD), concomitamment à la constatation d'infraction.
