English to French Tech/Engineering Construction / Civil Engineering Contract for the supply of aircraft parts
Hi all,

Another question within the context of my "Work Package Agreement" for the provision of aircraft parts :
I am hoping someone can shed some light on the above term. It is listed as a part of a sub-work package of a "Work Package Agreement" :

"9.3 Liquidated Damages for Product Performance Warranty:

Liquidated damages for product performance warranty paragraph applicable
for Sub-WorkPackage 1 only as defined in article 3.2.
The liquidated damages defined in Article 6.4.2 "Product Performance
Warranty" of the MSA shall apply to any Underperformance of the Product or
of the Product Item. The amount of Liquidated Damages shall be determined
as defined below and would be limited to a maximum amount of 5% of the sub
workpackage 1 order total amount ***out of taxis***.

I have to admit, this one has me stumped. I have even began to wonder if this was not written by a Frenc-speaker who mistranslated "montant hors taxe" !
Any help would be greatly appreciated !
